201107590 <br />apparatus and facilities repaired or replaced. <br />1.12. The Common Area shall be illuminated in such areas as the Developer shall reasonably <br />determine, at least during such hours from dusk to Midnight, and as any of the offices or stores <br />shall be open for business to the public, and for a reasonable period thereafter, in order to permit <br />safe ingress to and egress from the Lots by Permittees, and shall also be illuminated during <br />such hours of darkness and in such manner as will afford reasonable security for the <br />Development. <br />1.13. Each Lot Owner shall use their diligent efforts to arrange with local police authorities to <br />(a) patrol the Common Area on the respective Lot owned by such Lot Owner, at regular <br />intervals, and (b) supervise traffic direction at entrances and exits to the Lots during such hours <br />and periods as traffic conditions would reasonably require such supervision. Notwithstanding <br />the foregoing, Developer may, if Developer deems necessary, hire private security guards to <br />increase the security in the Common Area and include the cost thereof as a JMCA Expense in <br />accordance with this Declaration. <br />1.14. The parties shall use their diligent efforts to require their respective Permittees to comply <br />with all regulations with respect to the Common Area, including, but not by way of limitation, <br />posted speed limits, directional markings and parking stall markings. <br />1.15. Other than outdoor sales areas approved pursuant to the terms hereof, all of the <br />Common Area shall be maintained free from any obstructions not required, including the <br />prohibition of the sale or display of inerchandise outside the exterior walls of buildings within the <br />Lots, including those within any recessed area. <br />2. Floor Area <br />2.1. All floor area, including entrances and returns, doors, fixtures, windows and plate glass <br />shall be maintained by the party occupying such floor area in a safe, neat and clean condition. <br />2.2. All trash, refuse and waste materials shall be regularly removed from the premises of <br />each store writhin the Lots, and until removal shall be stored (a) in adequate containers, which <br />containers shall be covered with lids and shall be located in areas designated by Developer so <br />as not to be visible to the general public, and (b) so as not to constitute any health or fire hazard <br />or nuisance to any party. <br />2.3. Neither sidewalks nor walkways shall be used to display, store or replace any <br />merchandise, equipment or devices, without the express written consent of Developer. <br />2.4. No use shall be made of the Lots or any portion or portions thereof which would (a) <br />violate any law, ordinance or regulation, (b) constitute a nuisance, (c) constitute an extra- <br />hazardous use, or (d) violate, suspend or void any policy or policies of insurance on the buildings <br />located thereon. <br />2.5. The parties shall use their diligent efForts to require all trucks, overnight carriers, delivery <br />vehicles, servicing their respective stores or offices to load and unload such vehicles so as not <br />to unreasonably interfere with the operation of the other buildings within the Lots. <br />2.6. Each party and all other occupants shall use their diligent efforts, promptly upon <br />receiving notice thereof, to notify each Lot Owner and Developer or their respective designated <br />representative, of any significant accident, loss, damage, destruction or any other situation which <br />arises in or about their respective buildings or the Common Area which could potentially result in <br />a claim or other action against Developer or such Lot Owner. <br />17 <br />Meadowlark Declaration <br />Lots 1 & Z-9 Subdlvision <br />
