EXHIBITB �oii� <br />RULES AND REGULATIONS <br />All Lots shall be governed by the following Rules and Regulations unless otherwise agreed by Developer, its <br />successors or assigns. Developer shall not be responsible for the violation or nonperformance by any other <br />Permittee of the Developer Property with regard to these Rules and Regulations; provided, however, that <br />Developer agrees to use its reasonable efforts to cause such Permittee to comply with these Rules and <br />Regulations. Unless otherwise provided, all terms used in these Rules and Regulations shall have the same <br />meaning as set forth in this Declaration. To the extent that the provisions of these Rules and Regulations are <br />inconsistent with the provisions of this Declaration, the provisions hereof shall control. <br />1. Common Area <br />1.1. The surface of the parking area and sidewalks shall be maintained level, smooth and <br />evenly covered with the type of surfacing material originally installed thereon, or such substitute <br />thereof as shall be in all respects equal thereto in quality, appearance and durability. <br />1.2. All papers, debris, filth and refuse shall be removed from the Lots, and paved areas <br />shall be washed or thoroughly swept as required. All sweeping shall be at intervals before the <br />buildings shall be opened for business to the public. <br />1.3. All trash and rubbish containers located in the Common Area for the use of permittees <br />shall be emptied on a sufficiently regular basis and shall be washed at intervals sufficient to <br />maintain the same in a clean condition. <br />1.4. All landscaping shall be properly maintained, including watering, removal of dead plants, <br />weeds and foreign matter and such replanting and replacement as the occasion may require. <br />1.5. All hard-surfaced markings shall be inspected at regular intervals and promptly <br />repainted as the same shall become unsightly or indistinct from wear and tear, or other cause. <br />1.6. All storm drain catch basins shall be cleaned on a schedule sufficient to maintain all <br />storm drain lines in a free-flowing condition and all mechanical equipment related to storm drain <br />and sanitary sewer facilities shall be regularly inspected and kept in proper working order. <br />1.7. All asphalt paving shall be inspected at regular intervals and maintained in a first class <br />condition without potholes, scaled areas, or damaged areas. <br />1.8. All surface utility facilities servicing the Common Area, including, but not by way of <br />limitation, hose bibbs, standpipes, sprinklers and domestic water lines, shall be inspected at <br />regular intervals and promptly repaired or replaced, as the occasion may require, upon the <br />occurrence of any defect or malfunctioning. <br />1.9. All Common Area amenities, benches, and institutional, directional, traffic and other <br />signs shall be inspected at regular intervals, maintained in a clean and attractive surface <br />condition and promptly repaired or replaced upon the occurrence of any defects or irregularities <br />thereto. <br />1.10. All lamps shall be inspected at regular intervals and all lamps shall be promptly replaced <br />when no longer properly functioning. <br />1.11.
