Every Ovcmer of a Lot within the Property shall be a member of the Association. <br />Membership in the Associarion is a condition of ownership of any Lot within the Properiy. <br />Membership shall be appurtenant to and may not be separated from ownership of any Lot that is <br />subject to assessment. The Association shall have one class of voting membership that shall be <br />and include the Owner of each Lot contained in the Property. When more than one (1) person <br />holds an interest in any Lot contained within the Property, all such persons shall be members of <br />the Association but any vote for such Lot shall be exercised as they among themselves determine <br />with no more than one (1) vote being cast with respect to any Lot. Voting privileges are <br />restricted to paid-up members only. <br />4. Each Owner of any Lot contained within the Property agrees to this <br />DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS <br />by acceptance of any conveyance of any Lot, or any portion thereof, including subsequent lots <br />created by a subsequent resubdivision of these current lots whether or not it is so expressed in <br />any such conveyance. <br />B. Lot Restrictions <br />1. All Lots within the Property shall be known and described as residential Lots. No <br />commercial or business enterprise shall be conducted or operated within the Property. No lot or <br />lots shall be divided or split to create smaller building areas. Lots may be combined, or <br />combined and divided, to establish larger building areas. <br />2. All construction and building shall be so performed that it will comply with the <br />requirements of the building codes and ordinances of the City of Grand Island, Nebraska. <br />3. No building or dwelling shall be moved into the Property and placed upon a Lot. <br />No pre-fab, modular or mobile home shall be placed on a Lot. No trailer, tent garage, shack or <br />any other unsightly outbuilding shall be used within the Property as a dwelling at any time, nor <br />shall any structure of a temporary nature be used as a residence. <br />4. No animals of any kind, including, but not limited to, livestock, chickens, or fowl, <br />shall be raised, bred, housed, quartered or kept on any lot, except that two (2) household pets <br />consisting of dogs or cats, along with other usual ordinary household pets confined to cages or <br />aquariums within the dwelling shall be permitted provided they are not kept, bred, housed, or <br />maintained for any commercial purpose. In no event shall swine of any type be permitted. Any <br />such domestic animals kept as pets must be restrained, quiet, orderly, and confined and kept off <br />the premises of other Lot owners so as not to disturb the peaceful enjoyment of other Lot owners. <br />All animal waste generated by pets must be promptly and appropriately disposed of so as not to <br />be offensive to the owner of any other Lot. <br />5. No noxious or offensive activity shall be permitted on any Lot nor shall there be <br />anything done thereon which may become an annoyance or nuisance to the neighborhood. <br />6. Only single family detached dwellings and townhouses (herein collectively <br />referred to as "dwelling" or "dwellings") shall be permitted to be built on any Lot. No basement <br />house or apartment may be built on any Lot. No structure shall be erected, altered or permitted <br />to remain on any Lot other than one (1) dwelling, a private attached garage for not less than two <br />3 <br />
