�, <br />�Q�10�97� <br />DESCRIPTION OF LAND <br />The lands of the Declarant which are hereby subrriitted to this DECLARATION OF <br />RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS FOR STERLING <br />ESTATES HOMEOWNERS ASSOCIATION are a fee simple interest in the following: <br />Block Three (3), Lots One (1) through Eight (8), in the City of Grand Island, Hall <br />County, Nebraska; <br />Block Seven (7), Lots One (1) through Eight (8), in the City of Grand Island, Hall <br />County, Nebraska; and <br />Block Eight (8), Lots One (1) through Six (6), in the City of Grand Island, Hall County, <br />Nebraska, <br />all as surveyed and platted and is more particularly described as recorded in the office of the <br />Register of Deeds of Hall County, Nebraska. <br />III. <br />RESTRICTIVE COVENANTS RESTRICTIONS AND CONDITIONS <br />A. General Provisions <br />1. In consideration of the mutual benefits to be derived by the Owners of the lands <br />described in Article II hereinabove and any purchaser or purchasers, their heirs, devisees, <br />personal representatives, successors, assigns or grantees, the Declarant stipulates and agrees that <br />all of the lands described in Article II hereinabove shall be and are subject to the followmg <br />restrictive covenants, restrictions and conditions provided herein. All restrictive covenants, <br />restrictions and conditions shall run with the land. <br />2. The following definitions shall apply to this DECLARATION OF <br />RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS: <br />(a) "Association" shall mean the homeowners' association to be <br />formed by the Declaxant to be known as "Sterling Estates Homeowners <br />Association" and its successors and assigns. <br />(b) "Owner" shall mean an owner of a Lot as defined hereinbelow at <br />subsection (d). <br />(c) "Properiy" shall mean and refer to the lands described in Article II <br />hereinabove or any portion or subsequent resubdivision thereof. <br />(d) "Lot" shall mean any lot described in Article II hereinabove or any <br />portion or subsequent resubdivision thereof. <br />(e) "Developed Lot" shall mean any lot described in Article II <br />hereinabove or any portion or subsequent resubdivision thereof that has a <br />dwelling located thereon which is fit for occupancy. <br />� <br />
