2oioas237 <br />penalty or interest incurred vvhen Lessee is not so nati�ed at least ten (10) days prior to the date <br />on which any such item becomes delinquent, unless such delay is beyond the reasanable control <br />of Lessor. <br />ARTICLE VI <br />Acce tance of Fremises <br />6.1 Neither Lessor nor their agents have made any representations with respect to the <br />building, the land upon which it is erected, or the leased pr�mises, except as speci#'�cally set forth <br />herein, and no rights, easements or licenses are required by Lessee by implication or otherwise, <br />except as expressly set forth in the provisions of this Lease with Purchase Optian. The taking of <br />possession of the leased premises by Lessee shall be conclusive evidence that Lessee accepts the <br />sarne "as is" and that the leased premises and the building of which the sarne farm a part were in <br />good candition at the time possession was taken. Notwithstanding the fore�;o�r�g, L�ssor <br />represents and warrants that a retail floral business operated on the leased premises is acceptable <br />use of the leased property as currently zon�d and the leased pre�nises are legally accessible to be <br />operated in, the manner in which it has been operated since 2004 by Langer, Incorparated dba <br />Snow's Floral Company. <br />ARTICLE VI <br />Obli�ations of Maintenance <br />7.1 Lessor shall, during the initial term of this Lease with Furchase Option and any <br />extended lease term, repair and maintain in goad order and condition the structural portions of <br />the leased premises, ancluding the outside arid inside of exterior r�valls, foundations and structural <br />portions of the roof, gutters and downspouts. <br />7.2 Lessee shall carnplete such remodeling and improverraents upon the leased <br />premises as may be required for Lessee's intended usage of the leased premises as a floral shop <br />at Lessee's own cast and expense. <br />7.3 Lessee agrees, during the initial lease term and any extended lease terrn, ta k�ep <br />and maintain the interiar af the leased premises and each and every part thereof, including, <br />without limitation, all utilities, hookups and connections serving the leased premises (except as <br />oth�rwise provided) and the exterior and interior portions of all doors, windows, plate glass, <br />showcases and other things in and about the leased premises, in good order, condition and repair, <br />including, without limitation, all wiring, plumbing, sewage, heating and air conditioning systerns <br />(except as hereinafter pravided), pipes, conduits and all and any other utility and sprinkler <br />fixtures and equiprnent within (and without the leased premises to the extent that they serve the <br />said leased premises), fixtures and interior walls, floors, ceilings, signs and all interior and <br />exterior building appliances, appurtenances and similar equipment. Lessee further covenants and <br />agrees to keep the interior of the leased premises at all times in good order, condition and repair <br />as aforesaid, reasonable wear and tear, fire and other casualty excepted. <br />7.4 Lessee agrees, during the initial lease ternn and any extended lease term, to keep <br />and maintain the exterior grounds of the leased premises and each and every part thereof, <br />including, without limitation, all trees, shrubs, flawers, and other vegetation, including the lawn, <br />in good condition and repair, except that any maintenance or repair required to be performed ar <br />made to the parking lot, driveway or any paved area, including the sidewalk, of the leased <br />premises shall be the sole responsibility of Lessor and at Lessor's sole cost and expense. <br />4 <br />
