2oioos237 <br />assign to any insurance campany or ta any one claiming under or through any insurer, any right <br />or cause of action for damages to said property on or to the leased premises or to the building of <br />which the leased prernises are a part, co�npensated for by fire insurance or any of the risks <br />enumerated in any other hazard insurance, specifically including such darnage caused by <br />negligence, which it now has or may subsequently acquire against the other party during the terrn <br />of this Lease; provided, hawever, that the release, discharge, exoneration, and cavenant not to <br />sue herein contained shall be lirnited by the terms and provisians afthe waiver of subrogation, <br />endorsements consenting to a waiver of right of recovery, and shall be co-extensive therewith. <br />4.5 Lessee may bring its obligations to carry any insurance required hereby within the <br />coverage of any so-called blanket policy or policies of insurance now or hereafter carried by <br />appropriate amendment, endorsement, or otherwise, provided; however, the interests of Lessor <br />shall be as fully protected thereby as if Lessee obtained individual policies of insurance. <br />4.5 Said policies of insurance shall: (1) name Lessor as one of the insureds <br />thereunder; (2) be maintained at Lessee's sole cost and expense; and (3) contain a clause ar <br />endorsement to the effect that the policy may not be terminated ox znaterially amended except <br />after ten (10) days' written notice thereof to Lessor. Lessee shall deliver copies of said policies <br />or certi�cates of insurance to Lessor within thirty (30) days followin� Lessee's receipt of <br />Lessor's request therefor. <br />ARTICLE V <br />Taxes and Utilities <br />5,1 Lessee agrees to pay, when due, the following items: <br />(a) All charges for gas, electricity, water, telephone and other utilities <br />incurred at the Premises during the period of the term of the Lease; and <br />(b) All sales and use taxes izxiposed as the result of the business conducted on <br />the Premises and all personal property taxes assessed against personal property situated <br />thereon during the t�rm hereof. <br />5.2 Lessor agrees to pay, before delinquency, all real estate taxes and assessments <br />imposed an the leased premises, and shall provide Lessee proof af payment upon reasonable <br />request. <br />5.3 Lessor shall also have the right to endeavor to obtain a lowering of the assessed <br />valuation af the Premises or the improvements placed thereon. Lessee agrees ta coaperate and <br />join in any such endeavor. <br />5.4 Lessor shall promptly transmit to Lessee any statement relating to taxes or <br />assessments to be paid by Lessee hereunder, and shall promptly reirnburse Lessee for any <br />3 <br />
