201005185 <br />10. Alterations and Reeairs. Any necessary alterations or modifications <br />to the premises, shared space, and/or common facility to <br />accommodate Hamilton's or third parties' telecommunications <br />equipment and services shall be the responsibility of Hamilton. <br />Hamilton agrees not to make any alteration or modifications to the <br />premises during the term of the Agreement without the consent of <br />College Park which consent shall, not be unreasonably withheld. <br />College Park shall be responsible for making all typical repairs and <br />maintenance to keep the premises in good condition. Hamilton <br />shall be permitted, at its own expense, to place proximity locks and <br />security cameras on telecommunication building exterior doors, and <br />shall at all times during the term of this Agreement have possession <br />of keys or access codes as needed to access the premises and the <br />telecommunications building. <br />11. Liability of College Park. Hamilton waives any claims against <br />College Park for damages arising out of injuries to persons ar <br />property on ar about the Center far Higher Education containing the <br />premises for any cause arising out of the use of such space by <br />Hamilton, except when such injury or damage results from the <br />negligence of College Park or its officers, agents or employees. <br />College Park shall keep the entire Center for Higher Education <br />containing the premises insured for fire and extended casualty loss <br />during the term of this Agreement. <br />12. Liabilit of Hamilton. College Park waives any claims against <br />Hamilton for damages arising out of injuries to persons or property <br />on or about the Center for Higher Education containing the <br />premises far any cause arising out of the use of such space by <br />College Park, except when such injury or damage results from the <br />negligence of Hamilton or its officers, agents ar employees. <br />Hamilton shall be responsible for the safety of employees, students <br />and invitees using premises. Hamilton agrees to properly <br />supervise its employees and invitees while in attendance at the <br />premises. <br />13. Destruction of Premises. In the event of a partial destruction of the <br />premises during the term of this Agreement from any cause, <br />College Park shall forthwith repair the same at the earliest passible <br />time. If Hamilton is prevented from using the premises because of <br />casualty damage, the rent payable by Hamilton shall abate <br />proportionately according to the time it is unable to use the <br />premises. <br />14. Breach or Default. In the event of the breach of this Agreement ar <br />default in paying rent, the injured party shall have all rights and <br />
