Common facilities shall include all areas of the Center for Higher Education used by students of the Center for Higher Education for purposes other than instruction including, but not limited to, public entrances, hallways, public stairways, restrooms, lounges areas, snack areas, libraries and other public portions of the Center for Higher Education. 5. Term of Agreement. This Agreement shall be five (5) years, with the term to commence on July 1, 2010 (hereinafter referred to as "commencement date") and to end on June 30, 2015 (hereinafter referred to as `"termination date"), with two (2) options to renew far an additional ten (10) year period each (hereinafter referred to as "option period") (the initial term and option periods collectively referred to as the "term"). 6. Rental. Hamilton shall pay to College Park beginning July 1, 2010 a rental fee for the use of the premises in the amount(s) indi ated an Attachment C of this Agreement. Rental amounts shall b paid in annual installments unless otherwise agreed to in writing y College Park. 7. Use of the Premises by Hamilton. The premises shall be us~eed far telecommunication purposes as determined by Hamilton, including but not limited to sub-leasing space to third parties for telecommunications purposes provided however that Hamilton shall not be allowed to sublease space in the College Park Control Raam portion of the premises. Use shall also include access to the premises during weekend and evening hours and on holidays. Hamilton shall not use, ar permit to be used, the premises or common facilities for any purpose other than for those related to Hamilton's or third parties' telecommunication purposes. Hamilton shall comply with the rules and regulations promulgated by College Park for the premises, shared space, parking facilities surrounding the Center far Higher Education and common facilities a copy of which is attached to this Agreement as Attachment D. 8. Administration by College Park. College Park may employ, but shall not be required to employ, an administrator to coordinate the use of the Center for Higher Education. 9. Real Estate Taxes. College Park shall pay all real estate taxes, if any, including all paving, sewer and water assessments levied an the premises during the term of this Agreement.
