<br />2U1Q4148~ <br />2. Terms. <br />2.1 Term. This Lease shall commence on March 1, 2010, hereinafter "Commencement Date," <br />and shall terminate on November 31, 2014, hereinafter "Expiration Date," hereinafter, collectively hereinafter, <br />the "Term." This Lease shall not continue in effect from year to year thereafter and will expire on the date <br />stated above without further notice. <br />2.2 Amendments. Amendments and alterations to this Lease shall be in writing and shall be <br />signed by both the Lessor and Lessee. <br />2.3 No Partnership Intended. tt is particularly understood and agreed that this Lease shall not be <br />deemed to be nor intended to give rise to a partnership relation. <br />2.4 Transfer of Property. if the Lessor should sell or otherwise transfer title during the term of <br />this Lease, it will do so subject to the provisions of this Lease. <br />2.5 Right of Entry. The Lessor reserves the right for Lessor's employees or contractors to enter <br />the Property at any reasonable time to consult with the Lessee, make repairs, improvements, and inspections, <br />and any other customary seasonal work, none of which interfere with the Lessee in carrying out regular farm <br />operations. <br />2.6 Na Right to Sublease. The Lessor does not convey to the Lessee the right to lease or sublet <br />any part of the Property or to assign this Lease to any person or persons whomsoever. <br />2.7 Binding on Heirs. The provisions of this Lease shall be binding upon the heirs, executors, <br />administrators, and successors of both Lessor and Lessee in like manner as upon the original parties, except <br />as provided by mutual written agreement. <br />2.$ Lessor's Lien for Rent and Performance. The Lessor's lien provided by law on crops grown <br />or growing shall be the security for the rent herein specified and for the faithful performance of the terms of this <br />Lease. If the Lessee fails to pay the rent due or fails to keep the provisions of this Lease, all costs and <br />attorney fees of the Lessor in enforcing collection or performance shall be added to and become a part of the <br />obligations payable by the Lessee hereunder. <br />2.8 Lessee Possession Subject to Hazards. Lessee takes possession of the Property subject to <br />the hazards of operating a farm, and assumes all risk of accidents to himself, his family, his employees, or <br />agents in pursuit of farming operations. <br />2.9 Lessor Not Liable for Damages Caused by Elements. Lessor shall in no way be liable in <br />damages for failure of water supply or for any damage by the elements or otherwise, to any of the <br />improvements, nor for any loss or damage while improvements are under repair. <br />2.10 Mineral Rights. Nothing in this Lease shall confer upon the Lessee any right underlying said <br />Property, but same are hereby reserved by the Lessor together with the full right to enter the Property and to <br />bore, search and excavate far same, to work and remove same, and to deposit excavated rubbish, and with full <br />liberty to pass over said Property with vehicles and lay down any work any railroad track or rack, tanks, <br />pipelines, power lines, and structures as may be necessary or convenient for the above purpose.
