i } <br />g(}--~ ~l { 1 ' ~ ti c~ <br />5. Conveyance and Marketable Title. Sellers agree to <br />furnish the Buyer with an Abstract of Title showing them to be <br />the owners of a good and sufficient marketable title to the above <br />property, free and clear o£ liens, Sellers agree to convey the <br />above property by Warranty Deed. Sellers agree to pay the expense <br />of documentary stamps at the time of closing. In the event that <br />title examination reveals any valid title objections, the Sellers <br />shall have a reasonable time to correct sucks defects and in the <br />event the same cannot be corrected, all payments made hereunder <br />shall be refunded to the Buyer. Buyer has the option of waiving <br />any defect in title and accepting the same in such condition. <br />6. Taxes, Insurance and Duties o£ the Buyer. The Buyer <br />agrees to pay the real estate taxes for the year 1961 and to pay <br />all subsequent years real estate taxes and special assessments <br />on ali property sold hereunder. Buyer agrees to keep all proper- <br />ties sold hereunder free and clear of liens, taxes and encumbrances <br />and will not do or permit anything to be done that might impair <br />Sellers' security interest. The Buyer will carry insurance insur- <br />ing all graperty and improvements sold hereunder against all <br />casualty loss in the minimum amount of Thirty Thousand Dollars <br />SS30,000.oO), such policy of insurance to be payable as the <br />parties' interests appear hereunder. Buyer shall furnish receipt <br />of paid taxes and insurance to Sellers. The Escrow Agent herein- <br />after named shall hold the insurance policy. <br />7. Escrow Agent and Payments. The parties hereby designate <br />Winkler Realty Co. of Grand Island, Nebraska, as Escrow Agent <br />under this contract, An executed copy of this contract, Warranty <br />Deed conveying said property, and the Abstract of Title to said <br />property and all other documents, including insurance policies, <br />shall be depPSited with said Escrow Agent. Upon payment of all <br />principal and interest due hereunder by the Buyer, and upon his <br />performance of all the terms of this Contract of Sale, said <br />Escrow Agent is authorized to deliver said Warranty Deed, Abstract <br />of Title and other documents to the Buyer.
