Title and Authority <br />Mortgagor is seized of, and warrants title ta, an <br />indefeasible fee simple estate in the Property, has good;---- <br />absolute and marketable title to the Property free and clear of <br />all •liens, security interests, charges and encumbrances whatso- <br />` ever except for the liens of the Permitted Encumbrances (as <br />hereinafter defined), and has full right, power and author- <br />ity to assign, mortgage and encumber the same and to execute <br />and deliver the Note and this Mortgage. The "Permitted Encum- <br />brances" as used herein mean current real estate taxes and <br />assessments not yet due and payable, applicable zoning <br />ordinances, the Superior Mortgages {as hereinafter defined) and <br />sueh other liens, charges, encumbrances and other matters, as <br />are listed on Exhibit C attached hereto and hereby made a <br />part hereof. <br />3.
