The following <br />covenants, conditions and restrictions relating to this con- <br />dominium regime shall run with the land and any other persons who <br />use the property, including the persons who acquire the interest <br />of any office unit owner through foreclosure, enforcement of any <br />lien, or otherwise: <br />(a) The Grand Island Doctors Building Association, <br />Inc., a Nebraska non-profit corporation, has heen incorporated to <br />provide a vehicle for the management of the condominium. Each <br />office unit owner shall automatically be deemed a member of said <br />Association. The By-Laws and Articles of Incorporation of said <br />Association are attached hereto and designated as Exhibits C and <br />D respectively. <br />(b) AlI general common areas are for the use and <br />enjoyment of all office unit owners. The limited common areas <br />are for the exclusive use of the owner or owners of the office <br />unit or office units to which they are appurtenant, his employees, <br />customers, clients and invitees. The ownership of the common <br />areas shall remain undivided and no person or office unit owner <br />shall bring any action for the partition or division of the <br />general or limited common areas. The Grand Island Doctors Building <br />Association, Inc. may lease any parts or portions of the general <br />common area as it deems to be in the best interests of all the <br />members. <br />(c} The Association shall from time to time establish <br />rules and regulations for the use of the general common areas, <br />and all office unit owners and users shall be bound thereby. The <br />Association shall have thA sole jursidiction over and responsibility <br />for alterations, improvements, repairs, and maintenance of the <br />general common areas. <br />{d) The owners of office units appurtenant to limited <br />common areas shall, independently, establish rules and regulations <br />for the use of the limited common areas and shall have the sale <br />jursidiction over and reponsibility for alterations, improvements, <br />repairs, and maintenance of the limited common areas. <br />(e} The share of an office unit owner in the general <br />common areas and limited common areas shall be inseparable from <br />office unit ownership. Assessments against owners for insurance, <br />common area expenses and reserves, and far other expenses incurred <br />by the Association shall be made pursuant to the By-Laws. <br />{f) Nach office unit owner shall be responsible to <br />maintain, repair, and replace, at his expense, all portions of <br />his office unit which are not included within the common areas, <br />as set forth in Paragraph 4; and to refrain from painting, de- <br />corating oz changing the appearance of any portion of the ex- <br />terior of the office unit unless approved by the Association in <br />writing. <br />(g) Each office unit shall be used and occupied only <br />for the performance ar delivery of human health care services, <br />including, but not by way of limitation, medical, dental, and <br />psychological services, by licensed professional practioners, and <br />for no other purpose unless all of the office unit owners agree in <br />writing that a particular office u:,it may be used far a differer_t <br />purpose. No office unit may be subdivided into a smaller office <br />unit. <br />(h) too practice or use shall be permitted an the <br />condominium property or in any office unit which shall be an <br />annoyance to the other office unit owners or which shall in- <br />ter€ere with their peaceful use and enjoyment of their property. <br />All portions of the condominium praprty and each office unit <br />shall be kept clean and sanitary and no use thereof shall be made <br />which constitutes a violation of any laws, zoning ordinances, <br />geverniaental regulations, or roles and regulations of the As- <br />sociatian. <br />_k_ <br />
