<br />D. The Lessee shal'1 be permitted to use as pasture apg:oxi!mately <br />1,100 acres designated on Exhibit B hereto by being colored <br />~'yellowT' {800 acres} and "green" {}00 acres}. Lessee agrees <br />that the area colored in green on Exhibit B will be given <br />special consideration in its manaQernent and upkeep so as to <br />protect its ultra heavy cover of grass. The Lessee shall do <br />an adequate job of annual spreading of manure droppings so <br />as to prevent damage to the grasses thereon and to develop <br />some procedure to keep weeds at a minimum. <br />E. The Lessee shall use only as winter feed area, the approxi- <br />mate area shown in "red hatching' on the attached Exhibit B, <br />F. The Lessee agrees to place cattle on land designated for <br />pasture purposes only from May 1 to October 1 of each year <br />during the lease, UNLESS, a variance is authorized in writ- <br />ing by the Lessors. <br />6, Polution Control. In the event that the Federal, State or <br />County Governments o*.- any sub-division thereof places restrictions <br />or limitations on the pasturing of cattle on account of polution <br />effects or requires any expenditures to control polution, the Lessee <br />agrees to obey all such requirements and to assume and pay all costs <br />required to accomplish the required polution controls, <br />7. Assignment. Lessee shall not assign or sublet the premises <br />or any part thereof without the Lessors} prior written consent. <br />8. Mineral Reservation. Nothing in this lease shall confer <br />upon the Lessee any right to any minerals including oil, gas or <br />gravel underlyine the land but all such rights are hereby reserved <br />by the Lessors, together with the full right to enter upon the pre- <br />mises and to search and excavate for the same amito remove all such <br />deposits. The Lessors agree to reimburse the Lessee for any actual <br />damage it may sustain on account of any such activities and in the <br />event any such activities substantially interfere with the Leseets <br />cattle operation on the premises the Lessees rent shall be reduced <br />proportionately. All vravel pits, excavations, oil or gas wells, <br />tanks or permanently installed machinery or equipment shall be fenced <br />by the S~essors at their expense in such manner as to prevent damage <br />to Leseets cattle. <br />9. Indemnification & Liability Insurance. Since the Lessee <br />has the complete duty to keep the premises in repair, except as <br />provided above, the Lessee shall hold and save the Lessors harmless <br />from any and all liability by reason of personal injury to any <br />person or persons, and from all liability for damage or injury to <br />any property of any person or persons on or about the premises and <br />adjacent thereto occasioned by any act, failure to act or negli- <br />gence on the part of the Lessee, its agents, servants and employees, <br />and the Lessee agrees to carry indemnity insurance against liability <br />for such injuries and damages in an amount to be mutually agreed <br />upon by and between the parties hereto and furnish the Lessors a <br />copy of such coverages. <br />-4- <br />
