a <br />39~~6~~.a~D -4 <br />compensated by Lessor for the reasonable coGt of preparing and/oz seeding <br />such excess acreage; if, on the other hand, the total acreage of grepared <br />or seeded land is less than at the beginning of the lease, Lessor shall be <br />compensated by Lessee on the basis of the reasonable value of such <br />deficiency. <br />Neither party to this lease shall in any way be responsible for the <br />debts of, or liability for accidents or damages caused by, the other. <br />I. the Lessor should sell or otherwise transfer title to the premises, <br />it will da so subject to the previsions of this lease. <br />This lease shall not be deemed to have created a partnership relation, <br />and except as specifically provided herein neither party shall have <br />authoritg to obligate the ether without the ether's written consent. <br />Any differences between the parties as to their several rights and <br />obligations under this lease that are not settled by mutual agreement <br />after thorough discussion shall be submitted for arbitration to a cos~aittee <br />of three disinterested persons, one selected by each party hereto and the <br />third by the two tisis selected. Any Lawful decision by the committee shall <br />be accepted by both pazties <br />Shasld the Lessee fail to perform any of his obligations under this <br />base, the Lesser may im®ediately terminate the agreement. Rent far the <br />unexpired term shall b.:tome due and payable upon such termination. <br />Ln the event of nr®ature termination of this lease by virtue of the <br />Lessee's breach thereof, the Lessor ®ay attempt La lease the premises to <br />another gamy far the remainder' of the term or an} portion thereof, but <br />shall be under no abligatioa to da so. Any sues received under a subse- <br />quent lease sh911 be applied in reduction of the amount due from the <br />origi„„] Lessee. <br />Should the Lessee voluntarily move fram the premises prior to termina- <br />ti on of the lease, the Lessor shall be entitled to re-let the prises <br />without any abl3gatian to refcni3 ~y resulting overpayment by the ;.eases. <br />~ breach of the lease, the Lessor shall be entitled to re-enter <br />at3d repossess the premises one wer3c after written notice of intent to <br />tex:i.nats has been given the Lessee. <br />Shoald the Lessee default in nay of his obligations under this lease, <br />the Leaanr map 3a~ediateip and t+ithout notice perform thew in lieu of <br />declaring a termination of the lease. The Lessee shall pay the reasonable <br />value of such perfor~+re as en addition to his next rental payment. <br />
