~9-~,~~~~12 <br />acceptance as provided by law an accurate map and plat of such proposed <br />subdivision tc be known as Westgate Subdivision, designating explicitly <br />the iand to be laid out and particularly describing the lots, street, and <br />easements belonging to such subdivision, with lots designated by numbers, <br />streets by names, and easements by dimensions, and propose to cause the <br />plat of such subdivision when finally approved by the Regional Planning <br />Commission and the City Council to be acknowledged by such owners, certi- <br />fied as to accuracy of survey by a registered land surveyor, and to con- <br />tain a dedication of streets to the use and benefit of the public, and <br />of the easements to public utilities. In consideration of the acceptance <br />of the plat of said Westgate Subdivision, the Subdividers hereby consent <br />and agree with the City of Grand Island, Nebraska, that they will install <br />ox provide at their expense the following improvements: <br />1. Streets. The Subdividers agree to pave Westgate Road, Elsie <br />Drive, Gold Road, and Silver Road, within said subdivision in accordance <br />with plans and specifications approved by the Ha11 County Director of <br />Public Works, and to commence such paving prior to requesting an occupancy <br />permit for any structure located in said subdivision; provided, such <br />paving shall not commence for one construction season after installation <br />of sanitary sewer service within the public right-of-way. "Construction <br />Season" shall be defined to mean the period of time lapsing between <br />installation and the spring of the following year. Further, the Subdividers <br />agree not to protest any repaving district for the above mentioned streets <br />or Claude Road where it abuts said subdivision. <br />2. Water. Public water service is not available to the subdivision. <br />Therefore, the Subdividers may provide private wells for each structure <br />located within said subdivision. The Subdividers agree not to protest <br />the creation of any water districts within said subdivision, and further <br />agree to connect any and all structures to any water main abutting the <br />lot upon which said structure is located within three construction seasons <br />after completion of said water main. <br />3. Sanitary Sewer. The Subdividers agree to construct sanitary <br />sewer service to serve all lots within said subdivision in accordance <br />- 2 - <br />
