<br />~~~ C~;~ <br />determinations. if the parties cannot agree, such substituted index shall be <br />selected by the then presiding Judge of the Superior Court of .the State of <br />Arizona in and for the County of Maricopa <br />upon the application of either party. <br />8. Taxes and Assessments: (a) Lessee shall for the term pan as additional <br />rent, all real estate taxes and public assessments with respect to the leased <br />p°emises. Lessors warrant that at commencemat of the terms of this Lease *_here <br />will be no such public assessments and that ail streets and utilities, including <br />but not limited to electric power, gas, water and sewers will be in and paid for <br />by Lessors. <br />(b} Lessee shall pay the real estate taxes assessed for all tax periods, <br />wholly included in the term, and to Lessors for any fraction of a tax period <br />included in the term at the beginning or end, the corresponding fraction of the <br />real estate taxes assessed for the period. All tax payments shall be made at <br />leaset fifteen (15) days before the last day upon which the taxes may be paid <br />without interest or penalty, except that payment for the period in which the <br />term ends shall be made not later than the end of the term, and if the amount <br />is not then determinable shall be made on the basis of the last prior tax. with <br />readjustment as soon as the correct amount is determinable. Lessee sha?1 pay <br />the same at the same time and in the same manner as hereinafter provided with <br />respect to payment of rent. <br />{c) In the event of any public special or betterment assessments for <br />improvements hereafter installed Lessee may elect to have the assessments paid <br />in installmeres over the longest period permitted by law, and shall pay to the <br />public authorities charged with the collection thereof, at least fifteen {15) <br />days before they become due in each case, the entire assessment if the electlan <br />is not made, or if made, each installment, including interest, coming due during <br />the term, and shall pay to Lesaora not later than the end of the term for any <br />fraction of an installment period at the end of the term, the corresponding <br />fraction of the installment, including interest for the period. In the event <br />of payment of the entire assessment and termination of the term before the <br />expiration of the longest period permitted b~+ law for installment payments, Lessor <br />shall reimburse Lessee-for the part of the payment allocable to the part of such <br />period- *_hen emired, <br />-4- <br />
