<br /> <br />thirty {30) days prior notice specifying the termination date, unless Leases <br />before the termination date agrees to pay the excess cost when determined and <br />given Lessors adequate security for tt.e payment. If the balance of damages <br />available for restoration exceeds the cost of restoration the excess shalt be <br />held by and be the property of Lessors. In the event of exercise of eminent <br />domain wherein Lessee is able to continue the use of a portion of the pre~s2ses, <br />rent shall be abated proportionately to the portion of the preaises rendered <br />untenantable by such condemnation proceedings. <br />20. Default: (a) The occurance of any of the following events shall con- <br />stitute an event of default on the part of Lessee: <br />I. Pa.ilure to pay any installment of rental due and payable hereunder <br />-upon the date when said payment is due, said failure continuing for a period <br />of thirty (30) days after written notice of such default. , <br />II. Default in the performance of any of Lessee's covenants, agreements, <br />or obligations hereunder, said default continuing for thirty (30) days after <br />written notice thereof from Lessor to Lessee, provided that if such default <br />cannot be cured within such 30-day period, then Lessee shall not be in default <br />hereunder if Lessee within such 30-day period commences curing of such default <br />and diligently and in good faith prosecutes the same. <br />III, A general assignment by Lessee for the benefit of creditnrs; <br />IV. The filing of a voluntary petition in bankruptcy by Lessee or the <br />filing of involuntary petition by Lessee's creditors, said petition remaining <br />undischarged for a period of sixty (b0) days. <br />V. The appointment o£ a receiver to take possession of substantially all <br />of Lessee's assets or of this leasehold, said receivership remaining undissolved <br />foc a period of thirty {30) days. <br />VI. Attachment, execution or other judicial seizure of substantially all <br />of Lessee's assets of this leasehold, such atachment, execution or ocher seizure <br />remaining undismissed or undischarged for a period of thirty (30} days after the <br />levy thereof. <br />(b) -Upon the happening o£-any such event of default, Lessors at any time <br />thereafter,mayt <br />-20- <br />
