200909920 <br />(a) All of the real estate taxes assessed against the leased premises which is <br />more particularly identified as Parcel No. 400037203 by the office of the Hall County <br />Assessor. <br />(b) All of the common area maintenance expenses. Common area shall <br />include all of the surrounding area to the structure located on the leased premises, <br />including but not limited to the drives, parking areas, landscaped or green areas in the <br />entire subdivision. <br />Common area maintenance shall include but not be limited to snow removal, <br />mowing, weed elimination and storm sewer. <br />(c) A user fee of twenty cents ($0.20) per square foot of the leased premises <br />per year to be considered a user fee to be used for the purposes of Lessor making any <br />replacement of surfaces of the parking area and drives servicing such area. This amount <br />is assessed over and above the normal maintenance costs of the common area. <br />Except as otherwise provided hereinabove, the additional rent set forth above shall be <br />billed when ascertained or incurred by the Lessor. Payment of the additional rent shall be made <br />within thirty (30) days after the Lessee or its sublessee is billed for such sum ar sums. <br />In the event that the base rent is not paid by the fifth (St") day of each month, the Lessee <br />shall pay the Lessor a late charge in the amount of Twenty-Five and Na/100 Dollars ($25.00), <br />plus interest on any such delinquent rent from the due date thereof until payment at the rate of <br />sixteen percent (16%) per annum. In addition, in the event a check for any rent due hereunder is <br />returned by the Lessor's bank unpaid, a returned check charge in the amount of Twenty-Five and <br />No/100 Dollars ($25.00) shall be paid by the Lessee to the Lessor. <br />5. l~oldin~. Any holding over after the expiration of the lease term, <br />shall be construed to be a tenancy from month to month at the monthly base rental rate of <br />Four Hundred Twenty-Four and No/100 Dollars ($424.00) and shall otherwise be on the <br />terms and conditions herein specified. <br />6. Use of the Premises. The Lessee or its sublessee may use and occupy the leased <br />premises for any lawful purposes, except that the Lessee shall not use or occupy not permit the <br />lease premises or any part thereof to be used or occupied for any unlawful business, use, or <br />purpose, nor far any business, use, ar purpose deemed disreputable or extra-hazardous, nor for <br />any purpose or in any manner which is in discovery of any such unlawful, disreputable, or extra- <br />hazardous use take all necessary steps, legal and equitable, to compel the discontinuance of such <br />use and to oust and remove any subtenants, occupants, or other persons guilty of such unlawful, <br />disreputable, or extra-hazardous use. The Lessee shall indemnify the Lessor against all costs, <br />expenses, liabilities, losses, damages, injunctions, suits, fines, penalties, claims, and demands, <br />including reasonable attorney fees, arising out of any violation of default of this provision. <br />7. Utilities. The Lessee or its sublessee shall, at their awn expense, obtain and be <br />responsible for all utilities used by the Lessee on the leased premises and shall not permit water <br />
