244905357 <br />Fargo as owner of the Building, shall have the right to cure any default of the City so long as Wells <br />Fargo has legal title to the Building. <br />12. Surrender. City shall, upon terminatioz of this Lease, whether by lapse of time or <br />otherwise, peaceably and promptly surrender the Leased. Premises, shall farfeit all rights, titles and <br />interests in and to the Leased Premises and City shall remove the Building within ninety (90) days <br />of such termination and shall immediately vacate the Leased Premises except for purposes of <br />removing the Building. If City remains in possession after the termination of this Lcasc, without a <br />written lease duly executed by the parties, City shall be deemed a tenant at will. <br />13. Notices. All notices, demands, requests, approvals, consents, offers, statements, and <br />other instruments of communication required ar permitted to be given pursuant to the provisions of <br />this Lease, shalt be in writing and shall be deemed to have been given when delivered in person, by <br />Federal Express or other 24-hour delivery service, or three (3) business days aftex being deposited <br />in the United States mail by cert~ed mail, return receipt requested, postage prepaid, addressed to <br />the~other party at its address hereinbelow set forth: <br />City of Grand Island <br />Attn: Mayor <br />P.O. Recordation. Former Park, the City and Wells Fargo each agree to execute and <br />retard a short form notice of this Lease. <br />1S. Entire a nt. This Lease constitutes the entire agreement between Former <br />Park, Wells Fargo and the City regarding the subject matter hereof and supersedes all oral <br />statements and prior writings relating thereto. Except for those set forth in this Lease, na <br />representations, warranties or agreements have been made by Former Park, Wells Fargo or the City, <br />to the other with respect to this Lease, or the obligations of Former Park, Wells Fargo or the City in <br />connection therewith. The normal rule of construction that any ambiguities be resolved against the <br />drafting party shall not apply to the interpretation of this Lease nr any exlu'bits or amendments <br />hereto. <br />16. Binding Effect. This Lease shall run with the land and be binding upon and inure to <br />the benefit of the parties hereto and their respective petinitted successors and assigns. <br />4 <br />
