<br />200901988 <br /> <br />4.11 Window Coverings. No reflective materials, including, without limitation, <br />aluminum foil, reflective screens or glass, mirrors or similar type items shall be installed or <br />placed upon the outside or inside of any windows of a unit without prior written approval of the <br />Association. No enclosures, blinds, shades, screens or other items affecting the exterior <br />appearance of a unit or any limited common elements reserved for the use of such unit shall be <br />constructed or installed in any unit or limited common elements without prior written consent of <br />the Association. <br /> <br />ARTICLE V. <br /> <br />MAINTENANCE AND REPAIR OF COMMON ELEMENTS AND UNITS <br /> <br />5.0 Duties of the Association. The Association shall maintain, repair and make <br />necessary improvements to all common elements, except for those portions of the common <br />elements which the owners of the units are obligated to maintain pursuant to section 5.1 of this <br />Declaration. The portion of the common elements that the Association shall maintain includes, <br />without limitation, all common facilities and improvements, landscaping, drainage facilities, <br />roadways, streets, parking areas and sidewalks. The Association's duties for maintenance and <br />repair of the common elements shall include the exterior portion of the units and building, the <br />land upon which the building is located, the space above the building, all bearing walls, column, <br />floors, roof, slabs, foundations, water and sewer pipes, ducts, conduits, wires and all other utility <br />installations of the building, except for the outlets thereof when located within Units, and all <br />structural parts of the common elements. All such repairs and maintenance shall be common <br />expenses and shall be paid for by the Association. Provided, however, the Association shall not <br />be responsible for the expenses associated with the repair, maintenance, or replacement of any <br />changes made to adjoining units pursuant to Section 4.3.3 of this Declaration. <br /> <br />5.1 Duties of Owners. Each owner of a unit shall maintain, repair, replace and restore, at <br />his own expense, all portions of his unit, subject to the Declaration and Rules and Regulations of <br />the Association. Each owner shall, at his own expense, maintain, repair, replace and restore all <br />doors, window glass, and any heating, cooling and air conditioning systems and equipment <br />exclusively serving his unit, and all electrical and plumbing fixtures and appliances exclusively <br />serving his unit, including, without limitation, laundry equipment, water heaters and other built- <br />in appliances. Each owner shall clean, maintain, repair, replace and restore all interior finishes, <br />including, without limitation, floor coverings and wall coverings. No owner shall remove, alter, <br />injure or interfere in any way with any shrubs, trees, grass or plantings placed upon the <br />condominium by the Declarant or the Association without first having obtained the written <br />consent of the Association. In addition, each owner shall be responsible for the maintenance and <br />repair of the limited common elements (except for the structural parts of the limited common <br />elements) to which he has the right of exclusive use pursuant to Section 2.6 of this Declaration. <br />Each owner shall take all necessary action to keep the limited common elements, to which he has <br />the right of exclusive use pursuant to Section 2.6 of this Declaration, free and clean from <br />unsightly accumulations of weeds, trash and litter. Each owner shall have an easement over, <br />across and through such portions of common elements as are necessary in order for the owner to <br />perform his obligations under this Section with respect to the maintenance, repair, replacement <br /> <br />{0886166.3} <br /> <br />- 9 - <br />
