Any application to any <br />governmental authority for a permit to make an addition, <br />alteration or improvement in or to any townhome shaiZ be <br />executed by the Bc.ard of F.dministratars only, without, <br />however, incurring any liability an the part of the Board of <br />Administrators ox• any of them to any contractor, subcon- <br />tractor or materalman on account of such addition, alter- <br />ation or improvement, or to any person having any claim for <br />injury to person or damage to property arising therefrom, <br />The provisions of this Section 2 shall not apply to to-an- <br />homes owned by the Developer until such townhomes shall have <br />been initially sold by the Developer and paid for. <br />Section. 3. Alterations or Enlargement of Common Elements <br />by Association. <br />There she li be no enlargement of the common elements <br />nor addition thereto if such enlargement or addition shall <br />cost more titan Five Thousand Dollars ($5,000.00) during any <br />single fiscal year, unless and until such a proposal is <br />approved in writing by owners balding at least seventy-five <br />percent (75$) of the townhomes in the Condominium Property <br />Regime, and until a proper amendment to the Master Deed has <br />been duly executed, acknowledged and recorded pursuant to <br />law, if required. <br />The cost of the alteration car enlargement and of a- <br />mending the Master Deed shall be a common expense and shall <br />be collected by special assessment against all townhome <br />owners. <br />AR'i'ZCLE VZZZ. RESTRTCTZUNS iiZriD RESEF2VATZUN5. <br />Section 1.
