Except as otherwise provided in the Condominium Documents, all <br />powers and duties of the Association shall be exercised by and through the <br />Board of Directors. <br />(B) Articles of Incorporation of the Association are filed with the Office <br />of the Secretary of State of the State of Nebraska_ Cmies of the Artiel6a <br />sutu ,iiG Byi8w:3 of iite ii33octa`cio i 6itaii be a"urni.shed- by rie Aee6u'ieU4on to all <br />Owners upon request. <br />(C) The power of designation and appointment of the Board for the <br />period of Declarant control as defined in Paragraph 27 (Declarant" Control) <br />has been and will be exercised by Declarant to the extent provided herein or <br />in the Bylaws, unless Declarant -sooner relinquishes its rights- of designation <br />and appointment by means of an instrument recorded in the records of the: <br />Register of Deeds of the County. <br />(D) Each Owner of a Condominium Unit shall become a Member of the <br />Association upon conveyance to him /her of his /her interest in a. Condominium <br />Unit and shall remain a Member for the period of his /her ownership. <br />(E) For the purposes of the Condominium Documents, the term "Board" <br />and "Board of Directors" shall refer to and be the same as the term "Execu- <br />tive Board" which may be found in the Nebraska Uniform Condominium Act. <br />(F) The Board shall adopt a bvci,,�:' for the Condominium and within. <br />thirty (30) days of the adoption of r_.: proposed budget, the Board shall <br />provide a summary of the budget to au Unit Owners, set a date for a "meeting, <br />of the Unit Owners to consider ratification of the budget as provided in the <br />Bylaws. Unless, at that meeting, the budget is rejected by two - thirds of all <br />the votes in the Association, the budge, shall be considered ratified, whether <br />or not a quorum is present. In the event the proposed budget is rejected, <br />the periodic budget last ratified by the Unit Owners shall be continued until <br />such time as the Unit Owners ratify a subsequent budget proposed by the <br />Board. <br />18. Management Contracts. <br />If entered into during the period of Declarant control, as defined in <br />Parag -rape 27 (Declarant Contivii (i) any management contract, service con- <br />tract, employment contract, or lease of recreational or parking area of Con- <br />dominium, if any, or (ii) any other contract or lease between the Association <br />and the Declarant or an Affiliate of the Declarant may be terminated without <br />penalty at any time after all the members of the Board are elected by the <br />Unit Owners as provided herein and in the Bylaws upon not less than one <br />hundred eighty (180) days' notice to the other party. This paragraph shall <br />not apply to any lease the termination of which would terminate the Condo - <br />mini'.:' r <br />.'2 or _educe `t,- _ - ,finless the real estate subject to that lease -was <br />included in the Condominium for the, purpose of avo;ding the right of the <br />Association to terminate a lease under this paragraph.
