Easements <br />(A) in addition to the easements as provided by the Nebrasxa Uniform <br />Condominium Act and easements of record, the Association and each Unit <br />Owner shall have the following non - exclusive easements which shall run with <br />the land: <br />(1) Encroachments. In the event that any portion of the Common <br />Elements encroaches upon any Unit, in the event any portion- of a Unit erg <br />croaches upon any other Unit or upon any portion of the Common Elements, <br />or in the event any encroachment shall occur in the future, as a result of <br />(a) construction, reconstruction, shifting, movement, or settling of the Build <br />ing; or (b) construction, reconstruction, shifting, movement,. alteration, .or- <br />repair to the Common Elements or Units; or (c) repair or restoration of #he- <br />Building or Units after damage by, fire or other casualty or concsemnation or <br />eminent domain proceedings, a valid easement shall exist for the encroachment' <br />and for the maintenance of the same so long as the structure stands. 111-the <br />event any one or more of the Units, Building, or other improvements compris <br />ing part of the Common Elements are partially or totally destroyed and are <br />then rebuilt or reconstructed in substantially the same location, and as a <br />result of such rebuilding any portion thereof shall encroach as provided in <br />the preceding sentence, a valid easement for such encroachment shall exist. <br />Such encroachments and easements shall not be considered or determined to <br />be encumbrances either on the Common E? ^ments or on the Units for purposes <br />of marketability of title or other purpc :,;�. -- . <br />(ii) Utilit Utility easements through the Property as may be <br />required for ut ty installation, maintenance, service, and repair, in order to <br />adequately serve the Project and the individual Units. <br />(iii) In ess and Egress. Easements in common with the Association and <br />each other Unit Owner through all the Common Elements for ingress and <br />egress, including all exits, passageways to exits, and any combination thereof <br />which may be required by codes, ordinances and /or authorities having juris- <br />diction over requirements for the life and safety of the occupants of the <br />structure and the Units located therein, subject to such reasonable rules and <br />regulations as may be imposed by the Assaociauvn. <br />(iv) Lateral and Subjacent Su ort. Each Unit and Common Element <br />shall have an easement or Tat <br />and subjacent support from every other <br />Unit and Common Element. <br />(v) Easements over Common Elements. The Board may grant ease- <br />ments, leases, licenses, and concessions over the Common Elements for the <br />installation and maintenance of utilities and for such other purposes as the <br />Board deems to be in the best interests of the Condominium. <br />(B) ROvftap Easement. Notwithstaiading any provision hereira to the <br />contrary, y t ese presents is hereby granted, bargained, sold and conveyed <br />to the Owner of Class "B" Unit 201, its successors and assigns forever, an <br />exclusive permanent easement for the installation, maintenance, repair, <br />replacement or substitution of antennas and /or other electronic or communi- <br />cations devices and equipment on the roof of the Building together with the <br />right of access through the Class "C" Property, Class "A""- Limited Property <br />-12- <br />a <br />W <br />
