84 00550'7 <br />behalf of the available participating Class "A" Property Units by the Declar: <br />ant or its designee. <br />12. Use of General and Limited Common Elements. <br />(A) Each Owner may use the Common Elements in accordance with the <br />purposes for which they are intended, so long as such use does not hinder. <br />or encroach upon the lawful rights of other Owners. The Association may <br />adopt and amend from time to time Rules and Regulations governing the use: <br />of Common Elements, provided that such Rules and Regulations shall be:' <br />uniform and non - discriminatory. Each Owner, by the acceptance of a deed or <br />other instrument of conveyance or assignment, agrees to be bound `, by all <br />such Rules and Regulations. Copies of such Rules and Regulations- as <br />amended shall be furnished by the Association to all Owners and occupants of <br />the Proleut upon request. ' <br />(B) In addition to the rights of use herein described and elsewhere <br />described in this Declaration, the Association, its Board or Managing Agent, <br />shall have an unrestricted, irrevocable easement to traverse, cross, and <br />utilize any portion of the Common Elements which may be necessary in order <br />to install, maintain, repair, or replace any Common Elements. <br />(C) Each of the Owners shall have a nonexclusive right in common with <br />all of the other Owners to the use of all ewalks and streets located within <br />the entire Condominium Project, if any <br />13. Allocated Interests. <br />The Allocated Interests for each unit of the Condominium Project <br />are shown on 'Exhibit E, Schedule of Allocated interests ( "Schedule ") attached <br />hereto and incorporated herein by this reference. This Schedule will be used <br />to determine assessments for each Unit and to determine voting rights. <br />Assessments to a Unit and voting rights with respect to Class "C" Property . <br />were calculated by first allocating twenty percent (20 %) to Class "B" Units in <br />general and eighty percent (80 %) to Class "A" Units in general which division <br />is approximately the area of each class of property in relation to the total <br />area of the Project, and then determining each Unit's initial sale price as a <br />percentage of the total initial sale prices of all the Units in the Project. For <br />assessments to a Class "A" Member with respect to Class "A" Property, each <br />Class "A" Member's Unit's initial sale price as a percent of the total initial <br />sale price of all the Units classified as Class "A" Property was computed and <br />the Allocated Interests are set out on Schedule of Class "A" Allocated Inter- <br />ests, Exhibit "F ". For assessments to a Class "B" Member with respect to <br />Class "B" Property, each Class "B" Member's Unit's initial sale price as a <br />percentage of the total initial sale price of all Units classified as Class "B" <br />Property was computed and the Allocated Interests are set out on Schedule of <br />tIB" Allocated crests Exhibit "u-11 A:: fut„ d° -- u °,.ti.'."'.."' _.g <br />Glass 1_cr�ated lrt _ �o 0. <br />Allocated Interests shall be based on these exhibits.
