84 -- 00550 7 merly allocated to the subdivided Unit to the new Units in any reasonable manner prescribed by the Owner of the subdivided Unit. All costs and expenses incurred in ccannection with said Su- bdiVtSivu 1 shall be hilly paid by the Owner of the subdivided Unit Owner. Such costs and expenses shall be treated as an assessment to said subdivided Unit and payment therefore shall be enforced and collected in the same manner as all other assessments pro- vided for herein. H. Use and Occupancy. (A) The Owners of a Unit shall be entitled to the exclusive ownership` and possession of their Unit. Unless a vote of two - thirds of the members- 6f the Executive Board approve another use, each Class "A" -Unit shall be occupied and used only as a residential dwelling. Retail /commercial -uses shall be permitted in the Class "B" Units. (B) Notwithstanding Subparagraph (A) above: (1) Until Declarant has completed all of the contemplated improve- ments and closed the sales of all of the Units, Declarant and its employees, representatives, agents, and contractors may maintain business and sales offices, signs and other marketing devices, construction facilities, model Units, and other facilities on the Project in any Class "A" or "B "` Unit and the Class "C" Property. (2) The Associ^tk�n, Dee:". - ant or Affiliate may ,use any Unit which it owns or leases as a business office and /or residence for any on -site resi- dent manager or custodian. (C) Declarant and its employees, representatives, agents, and contrac- tors shall have the right of ingress and egress over the Common Elements as in Deciarant's discretion may be necessary to complete the Project. (D) No Unit shall be occupied for living or sleeping purposes by more persons than it was designed to accommodate safely. (E) An Owner may transfer any or all of his /her rights to use the Unit or the Common Elements to his or her tenant. Under no circumstances, how- ever, shall the Owner be relieved of his or her responsibilities as an Owner hereunder. All Class "A" Property Units shall be rented, leased and sub- leased until June 30, 1990 through a rental pool under the terms similar to those terms contained in the Rental Pool Agreement, attached hereto as Exhibit "H" and incorporated herein by this reference; provided that the Class "A" Property Units may be occupied by Owners or Owners' immediate family, business clients or employees (hereinafter referred to collectively as "Personal Use ") and not allow the Unit to be available to participate in the rental pool; provided further that if the Unit has been used for Personal Use initially after the Owners acquired title to the Unit, the Owner cannot make the Unit available to participate in the rental pool until after December 31, 1985, unless the Declarant in the Declarant's sole discretion determines that such Unit's availability for participation in the rental pool will not cause the Condominium Project to exceed the lawful number of unaccredited investors under Federal and state securities laws.
