<br />200807950 <br /> <br />C. Payment of other sums advanced by Lender to Borrower from tinle to time, and as <br />security for the payment of any and all other indebtedness of the Borrower to Lender which may <br />arise, and advances made to protect the Property. <br /> <br />D. The performance of all covenants and agreements of Borrower set forth herein. <br /> <br />Borrower, to protect the security of this Deed of Trust, agrees with Lender as follows: <br /> <br />1. Payment of Principal and Interest. Borrower shall promptly pay when due the <br />principal of and interest on, and any fees or charges provided in the Note or in this Deed of Trust. <br /> <br />2. Title. Borrower is the owner of the Property, has the right ffild authority to convey <br />the Property, and warrants that the lien created hereby is a first and prior lien on the Property and the <br />execution and delivery of this Deed of Trust does not violate any contract or other obligation to <br />which Borrower is subject. Borrower will forever warrant and defend the title thereto against the <br />claims and demands of all persons whomsoever and it will, at its expense, maintain and preserve the <br />lien of this Deed of Trust as a first paramount lien against the Property. <br /> <br />3. Taxes. Borrower shall pay each installment of all t:a.x.es and special assessments of <br />every kind, now or hereafter levied against the Property or any part thereof, before delinquency, <br />without notice or demand, and shall, before the delinquent date provide Lender with evidence of the <br />payment of the same. <br /> <br />4. Insurance. Borrower shall keep the Property insured against loss by fire and hazards <br />i.ncluded within the term "extended coverage" for their insurable value and policies for the same shall <br />include a standard mortgage clause showing Lender herein as an additional insured. In the event of <br />loss, Lender is authorized to adjust, collect and compromise all claims thereunder and shall have the <br />option of applying all or part of the insurance proceeds to any indebtedness secured hereby in such <br />order as Lender may determine, to the Borrower to be used for the repair and restoration of the <br />Property or for such other purpose or object satisfactory to Lender without in any way affecting the <br />lien of this Deed of Trust. AllY application of the proceeds to the indebtedness shall not extend or <br />postpone the due date of any payments under the Note or cure any default thereunder or hereunder. <br />All of the above~mentioned insurance policies or certificates of such insurance satisfactory to Lender, <br />together with receipts for the payment of the premiums thereof, shall be delivered to and held by <br />Lender, which delivery shall constitute assignment to Lender of all return premiums to be held as <br />additional security hereunder. All renewal and replacement policies shall be delivered to Lender at <br />least thirty (30) days before the expiration of the expiring policies. Lender shall not by the fact of <br />approving, disapproving, accepting, preventing, obtaining or failing to obtain any insurance incur any <br />liability for or with respect to the anlount of insurance carried, the form of the legal sufficiency of <br /> <br />Page 2 of 12 <br />
