<br />200807950 <br /> <br />insurance contracts, solvency of insurance companies, or payment or defense of lawsuits, and <br />Borrower hereby expressly assumes full responsibility therefor and all liability, if any, with respect <br />thereto. Such policy or policies shall not be cancelled or modified without a thirty (30)-day notice <br />to Lender. <br /> <br />5. Escrows. Borrower, upon request of Lender, shall pay in the manner set forth in the <br />Deed of Trust given to secure the Promissory Note, monthly advance payments estimated by the <br />Lender to be sufficient to anticipate the payment of taxes, assessments and insurance as detennined <br />to be necessary by Lender, and agrees further that such advances may be held by Lender and <br />commingled with the Lender's own funds and other funds and, further, that Lender shall not be liable <br />for interest on such funds. Without waiving Lender's rights of future enforcement of this escrow <br />provision, Lender will initially allow Borrower to pay all real estate taxes, insurance premiums and <br />special assessment. This waiver shall remain in effect as long as: <br /> <br />A. There is no default under the Note or this Deed of Trust or any other <br />document securing said Note; <br /> <br />B. Evidence is provided, as required, to Lender that the insurance premiums, <br />real estate taxes and special assessments are paid when due. <br /> <br />6. Maintenance. Repairs and Com\'lliance with Laws. Borrower shall keep the Property <br />in good condition and repair; shall promptly repair, or replace any improvements which may be <br />damaged or destroyed; shall not commit or permit any waste or deterioration of the Property; shall <br />not remove, demolish, or substantially alter any of the improvements 011 the Property; shall not <br />commit, suffer or permit any acUo be done in or upon the Property in violation of any law, ordinance <br />or regulation; and shall pay and promptly discharge at Borrower's cost and expense all liens, <br />encumbrances and charges levied, imposed and assessed against the Property or any part thereot'; <br /> <br />7. Eminent Domain. If all or a portion of the Property is taken or damaged by reason <br />of any public improvement or condemnation proceeding, or in any other manner including deed in <br />lieu of Condemnation ("Condenmation"), or should Borrower receive any notice or other information <br />regarding such proceeding, Borrower shall give prompt written notice to Lender. Lender shall be <br />entitled to all compensation, awards, and other payments. Lender shall be entitled, at his option, to <br />commence, appear in and prosecllte in his own Hame any action or proceedings. Lender shall also <br />be entitled to make any compromise or settlement in connection with slIch taking or damage. <br />Condemnation proceeds or awards shall be credited to the last maturing installments of the <br />indebtedness secured and shall not extend or postpone the due date of the payments referred to in the <br />Note and under this Deed of Trust, or change the amount of such payments. If the proceeds payoff <br />all sums due and owing, the excess shall be paid to the Borrower. <br /> <br />Page 3 of 12 <br />
