<br /> <br /> <br />THIS DEED OF TRUST is made on this /5 day of September, 2008. <br /> <br />The Trustor and Borrower is Gordon Wales and Margaret Wales, husband and wife, jointly and severally, <br />whose address is 3030 Saint Paul Road, Grand Island, NE 68801. <br /> <br />The Trustee is John C. Hurd, a member of the Nebraska State Bar Association, whose address is 12480 <br />Street, Suite 800, Lincoln, NE 68508. <br /> <br />The Beneficiary is Robert L. Lassen, Personal Representative of the Estate of James P. Lassen, Deceased, <br />whose address is 5131 Quail Ridge Drive, Lincoln, NE 68516, also designated in this Deed of Trust as <br />"Lender" . <br /> <br />For valuable consideration, including the indebtedness identified herein and the trust herein created, <br />the receipt of which is hereby acknowledged, Borrower hereby irrevocably grants, transfers, conveys and <br />assigns to Trustee, in trust, WITH POWER OF SALE, for the benefit and security of Lender, under and <br />subject to the terms and conditions hereinafter set forth, the real estate that is more specifically described on <br />Exhibit A to this Deed of Trust which is made a part hereof and incorporated herein by this reference, <br />together with all buildings, improvements, fixtures, streets, alleys, passageways, easements, rights, privileges <br />and appurtenances located thereon or in any way pertaining thereto, and the rents, issues and profits, <br />reversions and remainders thereof, all proceeds of the conversion, voluntary or involuntary, or any of the <br />foregoing into cash or liquidated claims, including, without limitation, proceeds of insurance and <br />condemnation awards; and such personal property that is attached to the improvements so as to constitute a <br />fixture including, but not limited to, heating and cooling equipment and together with tIle homestead or <br />mm;tal interests, if any, which interests are hereby released and waived, all of which, including replacements <br />and additions thereto, are hereby declared to be a part of the real estate secured by the lien of this Deed of <br />Trust and all of the foregoing being referred to herein as the "Real Estate", "Property", or "Trust Estate", <br /> <br />This Deed of Trust is given for the purpose of securing: <br /> <br />A.
