<br />200807402 <br /> <br />16. Construction Lien Rights and Indemnification. No labor performed or materials furnished <br />and incorporated in a Unit with the consent of or at the request ofthe Unit Owner thereof or <br />its agent, contractor, or subcontractor, shall be the basis for the filing ofa lien against all or <br />any portion ofthe Unit of any other Unit Owner not expressly consenting to orrequesting the <br />same. Each Unit Owner shall indemnify and hold harmless all of the other Unit Owners <br />from and against all liability arising from the claim of any construction performed, or for <br />labor, materials, service, or products incorporated in the Unit at such Unit Owner's express <br />or implied request. <br /> <br />17. Nuisances and Lawful Use. <br /> <br />a. No nuisances shall be allowed or permitted upon the Condominium or any property <br />in which the Association owns an interest, nor shall any use or practice which is the <br />source of annoyance to occupants or which interferes with the peaceful possession <br />and proper use of the Condominium (or any property in which the Association owns <br />an interest) by the occupants thereof be suffered or permitted. All parts of the <br />Condominium shall be kept in a clean, attractive, and sanitary condition, and no <br />rubbish, refuse or garbage shall be allowed to accumulate, nor any fire hazard <br />suffered or permitted to exist. <br /> <br />b. No immoral, improper, offensive or unlawful use shall be made of the Condominium <br />or any property in which the Association owns an interest, or any part thereof, and all <br />valid laws, zoning and other ordinances, rules and regulations of all governmental <br />bodies having jurisdiction over the Condominium shall be observed. The <br />responsibility of meeting the requirements of governmental bodies for maintenance, <br />modification, or repair of the Condominium shall be the same as the responsibility <br />for the maintenance and repair of that portion of the Condominium concerned. <br /> <br />18. Administration and Management. <br /> <br />a. The administration of the Condominium shall be governed by the Condominium <br />Documents and decisions and resolutions of the Board. The Association shall <br />possess all of the powers enumerated in the Act and those necessary to govern, <br />manage, maintain, repair, administer, and regulate the Condominium and to perform <br />all of the duties required of it including, without limiting the generality of the <br />foregoing, the authority to grant, by and through the Board, utility (including but not <br />limited to electricity, gas, water, telephone, cable television and sewer) service <br />easements in, over, and under the Limited Common Elements and the Common <br />Elements. Except as otherwise provided in the Condominium Documents, all powers <br />and duties of the Association shall be exercised by and through the Board. <br /> <br />b. The Articles of the Association are filed with the Secretary of State of the State of <br />Nebraska. Copies of the Articles and the Bylaws of the Association shall be <br />furnished by the Association to all Unit Owners upon written request. <br /> <br />-7- <br />
