<br />200804872 <br /> <br />In the event of a default by the Tenant, the landlords may, at the election of <br />the landlords, either distrain for rent due and damages sustained or re-enter and <br />recover possession of the property as if the property were forcibly detained; and the <br />Tenant hereby waives any notice of such election and any demand for possession of <br />the property. <br /> <br />In the event that the Landlords elect to re-enter and recover possession of the <br />property, the Landlords may at the election of the landlords, either terminate this <br />Agreement or relet the property or any portion thereof on such terms and conditions <br />as the landlords may deem advisable, consistent with the landlords' obligations to <br />mitigate damages to the Landlords. Upon reletting the property, rent received by the <br />landlords shall be applied in the following order: <br /> <br />A. To the costs of such reletting, including brokerage fees and attorney's <br />fees for such re-entry and recovery of possession of the leased <br />premises. <br /> <br />B. To the unpaid rent of Tenant, who shall remain liable for the balance. <br /> <br />c. To any sums due, other than rent, from the Tenant to the landlords. <br /> <br />D. To future rent to become due and payable hereunder. <br /> <br />If such rent received by the landlords shall be insufficient to satisfy the current <br />obligations of the Tenant to the landlords, the deficiency shall be computed and billed <br />by the landlords to the Tenant monthly and shall be paid by the Tenant on or before <br />the tenth day of the month following receipt of each such billing. <br /> <br />Notwithstanding any election by the landlords hereunder, the landlords may, <br />at any time subsequent to the default of the Tenant, terminate this Agreement by <br />giving written notice of such termination to the Tenant. <br /> <br />xv. <br /> <br />CONTENTS AT RISK OF TENANT: All property of every kind and nature <br />belonging to the Tenant which may be in or about the property during the term of this <br />Agreement shall be at the risk and responSibility of the Tenant, and the landlords <br />shall not be liable for damage thereto or theft, misappropriation or loss thereof. The <br />Tenant releases and discharges the Landlords and the officers, directors, agents, and <br />employees of the landlords and all other Tenants from any liability which may arise <br />by reason of damage to property of the Tenant or in the custody of the Tenant in or <br />about the property, which damage is of a type covered by a standard policy of fire <br />and extended coverage insurance; and the landlords release and discharge the <br /> <br />6 <br />
