<br />200802904 <br /> <br />(a) Government Lots 5 and 6 in Section 23, and Government <br />Lots 5 and 6 in Section 26, all in Township 9 North, <br />Range 12 West of the 6th Principal Meridian, Hall County, <br />Nebraska; and <br /> <br />(b) All Platte River accretion lands deriving from and <br />adjacent to Government Lots 5 and 6 in Section 23, and <br />Government Lots 5 and 6 in Section 26, all in Township 9 <br />North, Range 12 West of the 6th Principal Meridian, Hall <br />County, Nebraska <br /> <br />(all of such real estate being hereinafter collectively referred to <br /> <br />as "the Crane Trust Land"); and <br /> <br />WHEREAS, a portion of the Leaman Land abuts, or may abut, the <br /> <br />Crane Trust Land, or a portion thereof; and <br /> <br />WHEREAS, Darrel Gloe and Sharon Gloe, Husband and Wife, and <br /> <br />Randall Alexander, Trustee, as the parties plaintiff, have <br /> <br />commenced an action in the District Court of Hall County, Nebraska, <br /> <br />bearing Case No. CI 06-832, wherein Leamans, the Crane Trust and <br /> <br />others are named parties defendant (such action being hereinafter <br /> <br />referred to as "the Boundary Line Suit"); and <br /> <br />WHEREAS, Leamans, on September 8, 2006, filed an Amended <br /> <br />Answer, Counterclaim and Cross-Claim in the Boundary Line Suit, and <br /> <br />in the counterclaim and cross-claim contained therein seek, among <br /> <br />other things, to have the South boundary of the Leaman Land <br /> <br />determined; and <br /> <br />WHEREAS, the Crane Trust takes no position as to the specific <br /> <br />location of the South boundary line of the Leaman Land, exceot to <br /> <br />the extent that such boundary line, or any portion thereof, is one <br /> <br />2 <br />
