80-- 0029i6 <br />Lease shall be a condition precedent to the right to enforce this <br />Lease against Landlord. <br />55. Superseding Agreement: It is expressly agreed <br />that this Lease supersedes all prior oral and written agreements <br />between the parties regarding the Demised Premises. <br />56. No Representations: <br />56.1 Tenant acknowledges that Landlord has made <br />no representations or warranties whatsoever, express or implied, <br />regarding the physical condition of the Demised Premises except <br />those contained in this Lease. <br />56.2 Landlord further hereby specifically <br />disclaims any representations or warranties, both express and <br />implied, with respect to the condition, habitability, or <br />suitability of the Demised Premises, or any part thereof, for the <br />use and purposes permitted hereunder or for any other purpose, <br />and Landlord does not represent or warrant that the Demised <br />Premises or any part thereof complies with any laws, ordinances <br />or regulations relating to the use anu occupancy thereof. <br />56.3 Tenant fully understands that there may be <br />certain repairs and alterations required for the continued <br />licensing and /or certification of the Demised Premises, and <br />Tenant shall be fully responsible for the cost of and for <br />effectuating any and all alterations, maintenance, repair and <br />replacements required to be made for the continued licensing and <br />certification of the Demised Premises and for any alterations, <br />maintenance, repair and replacements required to maintain and <br />preserve the Demised Premises in the condition provided for <br />herein. <br />57. Applicable Law: This Lease shall be governed by, <br />and construed in accordance with, the laws of the State of <br />Nebraska. <br />58. Headings: The descriptive headings used in this <br />Lease are for convenience only and shall not control or affect <br />the meaning or construction of any of its provisions. <br />59. Arbitration: <br />59.1 In the event any controversy arises between <br />Landlord and Tenant as to their respective rights under this <br />Lease, the same shall be submitted to arbitration to and in <br />accordance with the rules of the American Arbitration Association <br />and shall be conducted at its office nearest the Demised <br />Premises.
