s 0 <br />85--002.916 <br />reasonable travel cost shall ultimately be borne by the losing <br />party or in such proportion as the arbitrator shall decide. <br />59.2 Notwithstanding the foregoing, any dispute or <br />controversy regarding the non - payment of rent, late payment <br />charges, interest on unpaid rent, real or personal property taxes <br />and assessments, insurance premiums (including any payment due <br />under the worker's compensation law of the State of Iowa) , or <br />utilities shall not be subject to arbitration. <br />60. Attorneys' Fees: If Landlord or Tenant brings any <br />action or arbitration to interpret or enforce this Lease, or for <br />damages for any alleged breach hereof, the prevailing party in <br />any such action or arbitration shall be entitled to reasonable <br />attorneys' fees as awarded by the court or arbitrator in addition <br />to all other recoverable damages and costs. <br />61. Severability: In the event any part or provision <br />of this Lease shall be determined to be invalid or unenforceable <br />under the laws of the State of Iowa, the remaining portion of <br />this Lease shall, nevertheless, continue in full force and <br />effect. <br />62. Time: Time is of the essence of each and every <br />provision of this Lease. <br />63.
