<br />both, a Security Interest is hereby granted by Mortgagor, as
<br />provided by the Uniform Commercial Code of the State in which
<br />the above described real property is located), and the rents,
<br />issues and profits thereof, and the reversion or reversions,
<br />remainder or remainders, in and to said land, and together with
<br />the entire interest of Mortgagor in and to all and singular the
<br />tenements, hereditaments, easements, rights -of -way, rights,
<br />privileges and appurtenances to said land, belonging or in any
<br />wise appertaining thereto, including, without limitation, the
<br />entire right, title, and interest of Mortgagor in, to, and under
<br />any streets, ways, alleys, gores or strips of land adjoining
<br />said land, and all claims or demands whatsoever of Mortgagor
<br />either in law or in equity, in possession or expectancy, of, in,
<br />and to said land, it being the intention of the parties hereto
<br />that, so far as may be permitted by law, all property of the
<br />character hereinabove described, which is now owned or is here-
<br />after acquired by Mortgagor and is affixed or attached or
<br />annexed to said land, shall be and remain or become or consti-
<br />tute a portion of said land and the security covered by and
<br />subject to the lien of this Mortgage (all of which is collec-
<br />tively referred to herein as the "Mortgaged Property "), together
<br />with all accessions, parts and appurtenances appertaining or
<br />attached thereto and all substitutions, renewals or replacements
<br />of and additions, improvements, accessions, and accumulations
<br />to any and all thereof, and together with all rents, income,
<br />revenues, awards, issues, and profits thereof, and the present
<br />and continuing right to make claim for, collect, receive and
<br />receipt for any and all of such rents, income, revenues, awards,
<br />issues, and profits arising therefrom or in connection there-
<br />with. It is the intent hereof to subject to the lien of this
<br />Second Mortgage and Security Agreement all right, title, and
<br />interest of every nature whatsoever of Mortgagor in or to the
<br />real property and improvements thereon (and each parcel thereof) described on Exhibit "A", whether psucharight,
<br />title, or interest be correctly described or not, and all
<br />equipment and item of personal property of every nature used or
<br />useful in connection with the operations being conducted on such
<br />real property, howsoever and whenever acquired, and whether
<br />correctly described or not.
<br />Section 2. Indebtedness Secured. This Mortgage and
<br />Security Agreement is g ven to secure the payment of
<br />Indebtedness by Pester Refining to Mortgagee under the Inland
<br />Crude Oil reement in the amount of Four Million Dollars
<br />($4.0000006 and of all other indebtedness and obligations of
<br />the Pester Refining, the Affiliates or Mortgagor arising
<br />pursuant to the provisions of this instrument, and any and all
<br />
