r <br />85-•• 0007 17 <br />election upon a particular default or breach, or upon any sub- <br />sequent default or breach, shall not be construed as waiving the <br />right to exercise such option or election at any later date. <br />No exercise of the rights and powers herein granted and no delay <br />or omission in the exercise of such rights and powers shall be <br />held to exhaust the name, or be construed as a waiver thereof, <br />and every such right and power may be exercised at any time and <br />from time to time. <br />Section 20. Partial Releases. Mortgagee may, at any time <br />and from time to time, re ease any part of the Mortgaged <br />Property from the lien and security interest created hereby, <br />and any such release may be made without notice to the Mortgagor <br />and without affecting the personal liability of the Mortgagor, <br />or of any other person, for the payment of the indebtedness <br />hereby secured. No release of any part of the Mortgaged <br />Property shall in anywise alter, vary, or diminish the force or <br />effect of this instrument on the balance of the Mortgaged <br />Property. <br />Section 21. Interest Rate Limitation. No provision of this <br />instrument or of the Note s a require the payment or permit <br />the collection of interest in excess of the maximum permitted <br />by law. If any excess of interest in such respect is herein or <br />in the Note provided for, or shall be adjudicated to be so pro- <br />vided for herein or in the Note, the Mortgagor shall not be <br />obligated to pay such interest in excess of the amount permitted <br />by law. <br />Section 22. Notices. Any notice, request, demand, report, <br />or other instrumen—Ft-w9rc—h may be required or permitted to be <br />given to, or furnished to, or served upon, any party hereto, or <br />other person succeeding to any interest of a party hereto, shall <br />be deemed sufficiently given, or furnished, or served, if in <br />writing and delivered to such party, or person, or to an officer <br />of such party, or person, or deposited in the United States mail <br />in a sealed envelope, registered or certified, with postage and <br />registration or certification charges prepaid, addressed as set <br />forth on the first page hereof, or at such other address as the <br />party or person to be addressed shall have previously designated <br />by written notice to the party or person giving such notice, or <br />furnishing such report, or making such request or demand. <br />- 10 - <br />0 <br />
