The Buyers shall not assign this agreement without the consent <br />in writing of Merle L. Moore and Dorothy K. Moore. <br />6. That the Buyers shall not in any manner whatsoever encumber or <br />permit any lien to be filed against said premises on their account <br />during the existence of this agreement. <br />7. The Buyers shall not remodel or in any manner change the arrangement, <br />architectural design or build on to the present structure or <br />build or erect new structures on said premises without the consent <br />of the Sellers in writing. <br />8. It is specifically agreed by and between the parties hereto that <br />time is an essential element of this contract and in consideration <br />of any payment of either principal or interest remaining unpaid <br />for a space of thirty (30) days after the same shall become due, <br />or of the failure of said Buyers to make any of the said payments <br />of principal, interest, monthly payments, general taxes, special <br />assessments or special taxes, or as otherwise provided for herein, <br />or the breach of any covenant contained herein, this contract <br />shall, at the option of the Sellers, be forfeited and determined <br />and the Sellers shall have the right to re -enter and take possession <br />of said premises aforesaid. It is specifically understood that <br />in the event of default of the Buyers herein in the first five <br />years of the existence of this agreement, the Sellers shall be <br />permitted to obtain possession of such premises by strict fore- <br />closure and all payments made to the date of the default shall be <br />considered rent for the use of the premises and liquidated damages <br />for non - compliance with the terms of this aareement. <br />9. It is further understood and agreed that the Buyers shall receive <br />possession of the premises on May 1, 1983. Mrs. Sallinger is a <br />tenant in said premises who has been payina $149.00 per month <br />rent. The Buyers shall receive the rent due for the month of <br />May. In the event that Mrs. Sallinger remains on the premises <br />during the months of June and July, the Sellers shall supplement <br />the rent paid by Mrs. Sallinger for the months of June and July <br />In the amount of $149.00 per month by paying to the Buyers the <br />sum of $51.00 per month. The Buyers agree to accept the premises <br />subject to tha tenancy of Mrs. Sallinger. <br />10. The Buyers covenant and agree to hold and save the Sellers harmless <br />from any and all liability by reason of personal injury to any <br />property or person and from all liability for damage to any property <br />or person or persons on or about the premises occasioned by any <br />act, failure to act, or negligence on the part of the Buyers, their <br />agents, servants, and employees, and the Buyers aoree to carry <br />indemnity insurance against liability for such injury and damages <br />in at least the amount of $100,000.00 per person, $300,000.00 nor <br />accident, and 3100,000.00 for property damages. The names of <br />the Sellers shall be inscribed o: such policy as named insureds, <br />and the Sellers shall be provided a copy of such policy of <br />insurance. <br />11. In the event that the Buyers should violate the terms of this agree- <br />ment, the Buyers shall be required to nay all attorney's fees, <br />€z <br />
