F 7 <br />3. Time is of the essence in making of such payments and in the <br />event that any payment is not paid by the 10th of the month <br />in any instance, then interest at the rate of 15% per annum <br />shall be paid on the late payment from the due date until <br />such payment is made. <br />4. Each payment s�all be made to Merle L. Moore and Dorothy K. <br />Moore, or the survivor of them, or to whomever they shall <br />direct in writing. <br />The Sellers agree to deliver to Buyers, at their request, as soon as practical <br />after the execution of this contract, an abstract of title to said premises <br />for examination by Buyers or their attorneys with the understanding that upon <br />completion of the examination of said abstract, it shall be returned to the <br />Sellers or as hereinafter set forth, and it being understood and agreed that <br />upon notice of defects in title, the Sellers shall have a reasonable time within <br />which to perfect the same. It is understood and aqreed that the Sellers shall <br />have an obligation to bring the abstract of title up to date only once and <br />not again upon completion of all payments hereunder. <br />IT IS FURTHER AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS: <br />1. The Buyers shall pay all general taxes that may be levied or <br />imposed upon said property subsequent to the year 1983 and to <br />pay all installments of special assessments or special taxes <br />or liens becoming due or delinquent after this date and keep <br />said premises insured covering both fire and extended coverage <br />insurance, with loss payable clause attached directing payment <br />in the event of loss to the parties hereto as their interests <br />may appear in an amount at least equal to the principal amount <br />due the Sellers herein. <br />2. The 1983 taxes shall be apportioned between the parties herein, <br />with Sellers paying 4 /12ths of such taxes for the year 1983 and <br />the Buyers paying 8 /12ths of such taxes for the year 1983, with <br />the taxes to be computed based upon the taxes levied for the <br />year 1982. <br />3. The Buyers shall keep all of the buildings and fixtures on said <br />Premises in good repair and maintain all of the facilities on <br />said premises in good workino order. The said Buyers agree that <br />they will not deposit garbage or other offensive matter on the <br />premises but will, at their own expense, :,eep said premises and <br />property adjacent thereto continually in neat, clean and wholesome <br />condition and will keep any sidP,:alks near said premises cleared <br />of snow and ice or other ob,jectional things as the City Ordinances <br />or authorities or good safety practices may require. It is agreed <br />that the said Buyers shall be responsible for the upkeep, repair <br />or replacement of all water lines, sewer lines, water pipes, <br />gas pipes, plumbing, hydrants, windows and in general everything <br />located on said premises. <br />ra <br />i <br />
