86- 108146 <br />NOW, THEREFORE, in consideration of One Dollar ($1.00) and <br />the covenants contained herein, the parties agree as follows: <br />1. Grantor hereby consents to, approves and confirms the <br />construction easements heretofore granted to Grantee by Back <br />Bar Farm Co. and West Third Development Co. on properties des- <br />cribed on Page 1, Paragraphs A, B and C above, as described by <br />the terms of such instruments recorded as Document Nos. 86- 103797, <br />86- 103798, and 86- 103799 for the purposes therein set forth. <br />2. Grantee's use of the above described easements, approved <br />and confirmed herein, will not interfere with Grantor's prior <br />easement recorded as Document No. 85- 004707, records of Hall <br />County, Nebraska. <br />3. The parties agree that the purpose of said construction <br />easements is to permit Grantee to construct, operate, maintain <br />and inspect the Amick Acres Project Improvement Area, being a <br />channel improvement project in Hall County, Nebraska, designed <br />to drain water from less than 200 acres of land, together with <br />the necessary right of ingress and egress in connection with the <br />use of such easements. <br />4. The construction on the property included in the Owner's <br />Construction Easement identified as Document No. 86- 103798 will <br />be as is indicated by the Typical Berm Section on Construction <br />Plans AOV 7 -85 hereto attached, marked Exhibit "A" and made a <br />part hereof. <br />5. The construction on the property included in the Owner's <br />Construction Easement identified as Document No. 86- 103799 will <br />-2- <br />I <br />
