86- 143283 <br />(ii) to use the walls, footings, foundations, other <br />structural support and the Lot 2 ceiling for the support of the <br />Parking Garage, including the roof of the Parking Garage, Third <br />Level and /or to house Utility Conduits in such walls, footings, <br />foundation, supports and the plenum of the Lot 2 ceiling all in <br />accordance with the Construction Documents; <br />(iii)to enter upon and through and transport and use <br />personnel, materials, and equipment on and over Lots 1 and 2, to <br />the extent necessary to construct the Parking Lot and Parking <br />Garage and operate, maintain, repair and rebuild the Parking <br />Garage. <br />In using all of the foregoing easements the Owner of Lot 3, <br />and anyone using said easements pursuant to such Owner's authori- <br />zation, shall coordinate same with the construction of the <br />Improvements on Lots 1 and 2. The utilization of the foregoing <br />easements for the benefit of Lot 3 shall be undertaken, to the <br />extent reasonably practicable, in the least disruptive manner <br />with respect to the then uses of Lots 1 and 2 and the Improve- <br />ments thereon and such Improvements shall promptly be restored to <br />their original condition at no cost to the Owners and Tenants of <br />Lots 1 and 2. <br />Section 12.10. A non - exclusive easement so long as needed <br />for the benefit of Lot 3 or a replat on Lot 3 enter upon and <br />transport personnel, materials and equipment over Lots 1 and 2 to <br />every extent reasonably required to construct the Third Level <br />parking deck pursuant to construction documents approved by the <br />City of Grand Island and to maintain, repair and rebuild same. <br />-31- <br />u <br />I <br />
