88-- 103283 <br />forth in reasonable detail the expenditures and all such other <br />data and computations as shall be necessary to determine Lot 2's <br />allocated shared expense of Extraordinary Maintenance. Upon <br />completion of the reasonable and necessary Extraordinary Mainte- <br />nance item, Lot 2's and Lot 3's allocated shared expense of <br />Extraordinary Maintenance shall be payable within sixty (60) days <br />after the giving of such written notice by Landlord to Tenant of <br />Lot 2 and failure by the Tenant of Lot 2 or the Landlord to pay <br />their lot's allocated shared expense within sixty days shall <br />constitute an Event of Default. <br />Section S.S. Failure to Perform. If the Landlord fails <br />within ninety (90) days to begin performance and continue in a <br />reasonable fashion thereafter any reasonable and necessary item <br />of Extraordinary Maintenance on the Parking Garage after being <br />requested to do so in writing by the Tenant of Lot 2, then the <br />Tenant of Lot 2 may perform the reasonable and necessary Extra- <br />ordinary Maintenance by First giving notice to the Landlord prior <br />to seeking competitve bids and choosing the lowest responsible <br />bidder. Upon completion of the reasonable and necessary Extra- <br />ordinary Maintenance item, Lot 2's and Lot 3's allocated shared <br />expense of Extraordinary Maintenance shall be payable within <br />sixty (60) days after the giving of such written notice by Tenant <br />of Lot 2 to Landlord and failure by the Landlord or Tenant of Lot <br />2 to pay their allocated shared expenses within sixty (60) days <br />shall constitute an Event of Default. <br />-15- <br />
