Any act of either the <br />I Owners or Tenants waiving, or which may be held to have waived, any <br />specific default of the other party, shall not be construed or <br />held to be a waiver of any future default. <br />4. Operational Expenses. The Tenants shall furnish all <br />labor, equipment and expenses for the operation of the farm <br />except Owners shall furnish irrigation wells. Owners agree to <br />maintain said wells, pumps and other irrigation equipment at their <br />own expense. <br />5. Tenants Agree That: <br />(1) They will maintain the farm during their tenancy in <br />as good condition and repair as at the beginning, or as later <br />improved, normal wear and depreciation from causes beyond the <br />Tenants' control excepted. <br />(2) They will operate the farm in an efficient and <br />husband -like manner, will do the plowing, seeding, cultivating <br />and harvesting at the proper time and in the proper manner. <br />(3) They will keep in good repair all grass waterways, <br />and open ditches. <br />(4) They will not commit waste on or damage to the farm <br />and will use due care to prevent others from doing so. <br />(5) No timber on the farm shall be used for any purpose <br />without the prior written consent of the Owners. <br />(6) They will permit the Owners or their agent to enter the <br />farm at any reasonable time for repairs, improvements or <br />inspection. <br />(7) They will not encumber, assign, sublet or otherwise <br />transfer this Lease, or any right or interest in this Lease, <br />without the prior written consent of the Owners, and any such <br />transfer without Owners' consent is void. This Lease is <br />considered personal to the Tenants only. <br />(8) They will yield possession of the farm to the Owners at <br />the expiration of this Lease without further notice. <br />(9) They agree to indemnify and hold the Owners and the <br />property of the Owners, including the farm, free and harmless from <br />any and all claims, liability, loss, damage, or expense resulting <br />from the Tenants' occupation and use of the farm, specifically <br />including, without limitation, any claim, liability, loss or <br />damage arising: <br />-2- <br />U <br />�fitI <br />w <br />
