)i 10 53'A.3 <br />1 -14- <br />of all instruments of record affecting the property, <br />non - compliance with which shall affect the security of <br />this Mortgage, or shall impose any duty or obligation <br />upon the Mortgagor or any sublessee or other occupant <br />of the property or any part thereof, and the Mortgagor <br />shall do or cause to be done all things necessary to <br />preserve intact and unimpaired any and all easements, <br />appurtenances and other interests and rights in favor <br />of or constituting any portion of the Property. <br />§2.13. Mortgagee May Cure Mortgagor's Defaults. <br />If the Mortgagor shall fail to pay any installment of <br />rent or additional rent reserved under the Lease, or to <br />pay any insurance premium required for the insurance <br />specified in this Mortgage, or to pay any real estate <br />tax, assessment or other governmental levy or charge or <br />any Imposition or to make any other payment required to <br />be paid by the Mortgagor, as Lessee under the Lease, at <br />the time and in the manner provided in the Lease, or if <br />the Mortgagor shall fail to perform or observe any <br />other term, covenant, condition or obligation required <br />to be performed or observed by the Mortgagor under the <br />Lease or under this Mortgage and an Event of Mortgage <br />Default shall have occurred then, without limiting the <br />generality of any other provision of this Mortgage, and <br />without waiving or releasing the Mortgagor from any of <br />its obligations hereunder, the Mortgagee shall have the <br />right, but shall be under no obligation, after 48 hours <br />prior notice to the Mortgagor to pay any such <br />installment of rent or additional rent or any such <br />insurance premium or any such tax, assessment, levy, <br />charge, Imposition or other payment, and may perform <br />any other act or take such action as may be appropriate <br />to cause such other term, covenant, condition or <br />obligation to be promptly performed or observed on <br />behalf of the Mortgagor, to the end that the <br />Mortgagor's rights in, to and under the Lease shall be <br />kept unimpaired and free from default. If the <br />Mortgagee shall make any payment or perform any act or <br />take action in accordance with the preceding sentence, <br />the Mortgagee will give to the Mortgagor written notice <br />of the making of any such payment, the performance of <br />any such act or the taking of any such action. In any <br />such event, the Mortgagee and any person designated by <br />the Mortgagee shall have, and is hereby granted, the <br />right to enter upon the Property at reasonable times <br />and from any time and from time to time for the purpose <br />of taking any such action, and all monies expended by <br />the Mortgagee in connection therewith (including, but <br />not limited to, legal expenses and disbursements), <br />U <br />
