-12- <br />Mortgagor shall forthwith proceed with the restoration <br />of the remaining portion of the Property if required by <br />the provisions of the Lease and shall continue to <br />perform and observe all of the terms, conditions and <br />provisions of the Lease and of this Mortgage, <br />throughout any period of restoration or reconstruction, <br />and until the indebtedness secured hereby is paid. <br />Upon the completion of the restoration of the building <br />upon the Property, and upon the receipt by the <br />Mortgagor from the Lessor named in said Lease of any <br />condemnation proceeds not used for the cost of the <br />restoration of the building, the Mortgagor shall <br />forthwith pay over, to the extent permitted by the <br />Lease, any such proceeds not so used to the Mortgagee, <br />and such proceeds shall at the option of the Mortgagee <br />be applied in reduction of the indebtedness secured <br />hereby; provided, however, that to the extent that the <br />Mortgagor's Award so received by the Mortgagee shall <br />exceed the amount required to satisfy in full the then <br />total Secured Debt secured hereby, the Mortgagee shall <br />pay over to the Mortgagor the amount of such excess. <br />In no event shall the Mortgagee be required to satisfy <br />this Mortgage until the Secured Debt secured hereby are <br />fully paid and the Borrower is not entitled to incur <br />further liability to Mortgagee or any lender pursuant <br />to any of the Secured Debt, and the Mortgagee shall not <br />be required to release from the lien of this mortgage <br />any portion of the Property so taken until the <br />Mortgagee receives the entire award for the portion so <br />taken, to which it and the Mortgagor are entitled <br />hereunder and under the Lease. The provisions of this <br />Section shall control in the event of the condemnation <br />of the Property or any part thereof but only to the <br />extent not prohibited by or inconsistent with the <br />terms, covenants and conditions of the Lease and in <br />case of any conflict between the provisions of this <br />Section and the provisions of the Lease, the provisions <br />of the Lease shall prevail. The Mortgagor will not <br />enter into any agreement for the taking of the <br />Property, or any part thereof, with anyone authorized <br />to acquire the same by condemnation unless the <br />Mortgagee shall have consented thereto in writing. <br />S2.11. Performance of Lease.
