The description for the boundary line is consistent with the prior deed to the State of Nebraska and the description in the Complaint except that a new survey monument has been placed on or near the north bank of the active charmel along the western boundary line. The NOPC and the Plaintiffs believe that the description on Attachment BB is true and accurate and that there is no dispute as to the location of the boundary between the properties. The parties requested that the court adopt this description as the true and accurate boundary line subject to any and all rights of the NGPC and Plaintiffs to accretion lands located only on the part of the bouidary so:)th of the new survey monument set near the north bank of the riv!'>,r to th(. sOllthl~rn terminus of the western boundary at the thread of the river. 7. The PlaintifIs and the NGPC are the only parties, including the other Defendants in this case, with a claim of right, title or interest in the boundary line between Plaintiffs' and NOPC property. 8. The lands owned by NGPC do not abut, and NGPC does not occupy nor have any claim of right, title, or interest in (1) any land abutting the northern, eastern or southern boundaries of The Tract, or (2) any of the lands included within the boundary of The Tract, subject, only to any rights ofNGPC to accretion lands as described in paragraph 6 above. 9. The Plaintiffs and NGPC would like to have the common boundary line, described on Attachment BB confirmed to be the true and correct boundary between the NGPC and Plaintiffs' properties, subject to the accretion rights described above. 10. Pursuant to this court's authority under Neb. Rev. Stat. 9 34-301, Plaintiffs and Defendant State of Nebraska requested that this court determine and establish that the boundary described on Attachments AA and BB are the true and correct boundaries between the Plaintiffs' - 3 -
