j,.\ .' 200802265 Exhibit A. (The tract of land described on Complaint Exhibit A will hereafter be referred to as "The Tract.") Nebraska Department of Roads 1-80 - Northern Boundary 2. A tract of land owned by the State of Nebraska, Department of Roads, (NDOR), and used as a part of Interstate 80, abuts a substantial continuous portion of the northern boundary of The Tract. The metes and bounds description of the common boundary line between Plaintiffs' and NDOR property is set out on Attachment AA, attached to this Order. This description of the boundary line may vary from the description found in prior deeds, however, the parties agree that the description sct out on Attachment AA reflects the true and accurate boundary between the Plaintiffs' and NDOR's lands. 3. The Plaintiffs and NDOR, are the only parties, including the other Defendants in this case, who have any right, title, claim or interest in the location of the part of the northern boundary of The Tract described on Attachment AA. 4. Thc lands owned by the NDOR do not abut, and NDOR does not occupy nor have any claim of right, title, or interest in (1) any lands abutting the western, eastern or southern boundaries of The Tract, or (2) any of the lands included within the boundaries of The Tract. 5. The Plaintiffs and NDOR would like to have their common boundary line, described on Attachment AA, determined in this case to be the true and accurate boundary line between the NDOR and Plaintiffs' properties. Nebraska Game and Parks - Western BoundarY 6. A tract of land owned and occupied by the State of Nebraska, Game and Parks Commission, (NGPC), abuts the entire western boundary of The Tract. The legal description of the boundary line between Plaintiffs' and NGPC property is set out on Attachment BB, attached - 2 -
