Based on these facts the Court tinds that there is no genuine issue of material fact as to the Joint Motion and that the Plaintiffs and the State are entitled to Partial Summary Judgmcnt as follows: 1. Pursuant to authority granted in Neb. Rev. Stat. S 25-1315 and the undisputed facts set out above, the Court hereby establishes as the true and accurate boundary between the real estai;; of Plaintiffs and the Nebraska Department of Roads the line described on Attachment AA, attached hereto and incorporated herein by this reference.
