<br />200800062 <br /> <br />the extent that such boundary line, or any portion thereof, is one <br /> <br />and the same as some part or all of the North boundary line of the <br /> <br />TNC Land; and <br /> <br />WHEREAS, a question has arisen between the City of Wood River, <br /> <br />on one hand, and TNC on the other hand, as to the location of the <br /> <br />North boundary line of the TNC Land; and <br /> <br />WHEREAS, the City of Wood River and TNC have resolved and <br /> <br />settled the question as to the location of the North boundary line <br /> <br />of the TNC Land, and desire to reduce their resolution and <br /> <br />settlement to writing. <br /> <br />AGreement <br /> <br />NOW, THEREFORE, the City of Wood River and TNC do hereby agree <br /> <br />as follows: <br /> <br />1. The recitals set forth above are incorporated herein by <br /> <br />reference, the same as though repeated verbatim. <br /> <br />2. The North boundary line of the TNC Land, insofar as such <br /> <br />boundary line is one and the same as the South boundary line of the <br /> <br />City of Wood River Land, is the following-described line: <br /> <br />Commencing at the Northwest corner of Government Lot 3 in <br />Section 18, Township 9 North, Range 11 West of the 6th <br />Principal Meridian, Hall County, Nebraska, and assuming <br />the West line of Government Lot 3 in said Section 18 as <br />bearing S 00043'28" W, and all bearings contained herein <br />being relative thereto; thence 8 00043'28" W, on the West <br />line of Government Lot 3 in said Section 18, a distance <br />of 1141.16 feet to a point on the northerly high bank of <br />the Middle Channel of the Platte River, such Middle <br />Channel of the Platte River being depicted on the <br />original U.8. Government Surveys of Township 9 North, <br />Range 11 West of the 6th Principal Meridian, dated May <br />18, 1867, and Township 9 North, Range 12 West of the 6th <br /> <br />3 <br />
