<br />200800062 <br /> <br />WHEREAS, TNC is the owner of record of the following-described <br /> <br />real estate: <br /> <br />(a) Government Lot 6 in Section 17, and Government Lot 6 in <br />Section 18, all in Township 9 North, Range 11 West of the <br />6th Principal Meridian, Hall County, Nebraska; and <br /> <br />(b) All Platte River accretion lands deriving from and <br />adjacent to Government Lot 6 in Section 17, and <br />Government Lot 6 in Section 18, all in Township 9 North, <br />Range 11 West of the 6th Principal Meridian, Hall County, <br />Nebraska <br /> <br />(all of such real estate being hereinafter collectively referred to <br /> <br />as "the TNC Land"); and <br /> <br />WHEREAS, the government lots constituting a portion of the <br /> <br />City of Wood River Land are located to the north of the government <br /> <br />lots constituting a portion of the TNC Land; and <br /> <br />WHEREAS, a portion of the City of Wood River Land does or may <br /> <br />abut the TNC Land; and <br /> <br />WHEREAS, Darrel Gloe and Sharon Gloe, husband and wife, and <br /> <br />Randall Alexander, Trustee, as the parties plaintiff, have <br /> <br />commenced an action in the District Court of Hall County, Nebraska, <br /> <br />bearing Case No. CI 06-832, wherein TNC, the City of Wood River, <br /> <br />and others are named parties defendant (such action being <br /> <br />hereinafter referred to as "the Boundary Line Suit"); and <br /> <br />WHEREAS, the location of the South boundary line of the City <br /> <br />of Wood River Land is or may be an issue in the Boundary Line Suit; <br /> <br />and <br /> <br />WHEREAS, TNC takes no position as to the specific location of <br /> <br />the South boundary line of the City of Wood River Land, exceot to <br /> <br />2 <br />
