<br />200709653 <br /> <br />COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD ESTATES <br />SEVENTH SUBDIVISION IN THE CITY OF GRAND ISLAND, HALL COUNTY, <br />NEBRASKA, include Lots One (1) through Twenty-Five (25), Block One (1), Lots One (1) <br />through Five (5), Block Two (2) and Lots One (1) through Five (5), Block Three (3) all in <br />Summerfield Estates Seventh Subdivision in the City of Grand Island, Hall County, Nebraska. <br /> <br />III. <br /> <br />RESTRICTIVE COVENANTS. RESTRICTIONS AND CONDITIONS <br /> <br />In consideration of the mutual benefits to be derived by the Owner of Summerfield <br />Estates Seventh Subdivision in the City of Grand Island, Hall County, Nebraska, and any pur- <br />chaser or purchasers, their heirs, devisees, personal representatives, successors, assigns or grant- <br />ees, the Owner stipulates and agrees that all lots in Summerfield Estates Seventh Subdivision in <br />the City of Grand Island, Hall County, Nebraska, that are sold, transferred or conveyed, shall be <br />and are subject to the following restrictive covenants, restrictions and conditions. All restrictive <br />covenants, restrictions and conditions shall run with the land and are as follows: <br /> <br />1. All lots in the subdivision shall be known and described as residential lots. <br /> <br />2. All construction and building shall be so performed that it will comply with the <br />requirements of the building codes and ordinances of the City of Grand Island, Nebraska. <br /> <br />3. No building or dwelling house shall be moved into said subdivision and placed <br />upon a lot. No pre-fab, modular or mobile home shall be placed on a lot; no trailer, tent, garage, <br />shack or any other unsightly out-building shall be used in said subdivision as a dwelling at any <br />time, nor shall any structure of a temporary nature be used as a residence. <br /> <br />4. No barns, chicken houses, horse trailers, commercial work or sales shops, or other <br />buildings for the care and housing of fowl, rabbits or livestock shall be placed, maintained or <br />used on any lot; nor shall any fowl, rabbits or animals other than household pets be kept upon <br />any lot, and household pets shall not be kept, bred or maintained for any commercial purposes. <br />No noxious or offensive activity shall be permitted on any lot nor shall there be anything done <br />thereon which may become an annoyance or nuisance to the neighborhood. <br /> <br />5. There shall be no townhomes or condominiums on any lot. No basement house or <br />apartment may be built on any lot. No individual dwelling consisting of one level shall be con- <br />structed with less than 1450 square feet ofliving area, not including the garage. No dwelling <br />consisting of a two story design shall have less than 1250 square feet of living area on the ground <br />floor, not including the garage. <br /> <br />6. No structure shall be erected, altered, placed or permitted to remain on any lot <br />other than one dwelling, and private garage for not less than two (2) nor more than three (3) cars, <br />for each private dwelling, and any detached garage or other out-buildings incidental to the resi- <br /> <br />2 <br />
