~ . . 200702101 WHEREAS, the parries have agreed to amend paragraph 2 of Article 2.1 of the Lease Agreement to provide for four (4) more five (5) year renewal options upon the same terms and conditions of the Lease Agreement; and NOW, THEREFORE, in consideration of the foregoing premises and other mutual covenants and obligations hereinafter set forth. the parries hereto hereby agree as follows: 1. The recitals set forth above are incorporated herein by this reference. 2. Lessor acknowledges that Toukan Enterprises, Inc. now holds the interest as Lessee under the Lease Agreement by virtue of a succession of interest as described in the recital above. 3. Lessor and Lessee each acknowledge that the original term of the Lease Agreement commenced June 1, 1977 and the original term ,will terminate May 31, 1997. 4. Lessor acknowledges receipt of Lessee's notification to renew the Lease Agreement for the term of five (5) years commencing June 1, 1997 to May 31, 2002, and the' Lease Agreement is hereby renewed for said renewal term. 5.Paragraph two of Article 2.1 of the Lease Agreement shall be amended and henceforth shall hereinafter read as follows: "In addition to the renewal set forth in paragraph -+ of the Renewal and Amendment of Lease and Grant of Right of First Refusal Agreement LESSEE shall have the right and option to renew this Lease for four (4) additional, separate and successive terms of five (5) years each, ie. (a) June 1,2002. May 31, 2007; (b) June 1,2007. May 31,2012; (c) June 1,2012 - May 31, 2017; and (d) June 1, 2017 _ May 31, 2022, upon the same terms and conditions and for each renewal term, upon written notice to LESSOR at least 180 days prior to the expiration of the previous renewal term(s). Said notice shall be made pursuant to Article XIX." 6. Article XIX of the Lease Agreement shall be amended and henceforth shall read as follows: 2
